According to Article 36 TFEU, the relevant provisions on free movement of goods do not preclude prohibitions or restrictions on imports, exports or goods in transit, justified on grounds of the protection of national treasures possessing artistic, historic or archaeological value.

Néanmoins, la Cour a établi, sur base d'autres libertés fondamentales comme la libre circulation des marchandises et la libre prestation de service, qu'une telle autorisation préalable pouvait constituer une entrave à ces libertés fondamentales, si elle n'est pas justifiée.
However, the Court has held that, in the light of other fundamental freedoms, such as the free movement of goods and the freedom to provide services, such prior authorisation, if not justified, could be regarded as an infringement of these fundamental freedoms.
