The Commission is therefore proposing to the European Parliament and the Council, as requested, that the common rules and hence the tasks of the Agency should be extended to include air operations, pilots’ licences and, within the limits set by the Chicago Convention, the safety of third-country aircraft.

(10) Since the objectives of the action to be taken, namely to establish a common framework for the protection of soil, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level by reason of the scale of the problem and its implications in respect of other Community legislation on nature protection, water protection, food safety, climate change, agriculture and areas of common interest, such as human health protection, the Community may therefore adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

(41) Since the objectives of the proposed action, namely achieving a harmonised framework for the regulation of electronic communications services, electronic communications networks, associated facilities and associated services cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale and effects of the action, be better achieved at Community level, the Community may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

(7) considérant que l'exploitation en commun des résultats peut être considérée comme un complément découlant d'une recherche et d'un développement entrepris en commun ; que celle-ci peut s'effectuer suivant différentes modalités de fabrication ou d'utilisation de droits de propriété intellectuelle ou d'un savoir-faire qui contribue de façon substantielle au progrès technique ou économique ; que, pour atteindre les objectifs et avantages visés et justifier les restrictions de concurrence exemptées, ces modalités ne peuvent s'appliquer qu'à des produits ou procédés pour lesquels la mise en oeuvre des résultats de la recherche et du développement est déterminante ; que l'exploitation en commun ne se justifie donc pas lorsqu'elle concerne des améliorations qui n'ont pas été réalisées dans le cadre d'un programme de recherche et de développement en commun mais seulement à l'occasion de l'application d'un accord ayant un autre objectif principal, par exemple l'octroi de licences de propriété intellectuelle, la fabrication en commun ou la spécialisation et comportant seulement à titre accessoire certaines clauses relatives à la recherche et au développement en commun;
(7) The joint exploitation of results can be considered as the natural consequence of joint research and development. It can take different forms ranging from manufacture to the exploitation of intellectual property rights or know-how that substantially contributes to technical or economic progress. In order to attain the benefits and objectives described above and to justify the restrictions of competition which are exempted, the joint exploitation must relate to products or processes for which the use of the results of the research and development is decisive. Joint exploitation is not therefore justified where it relates to improvements which were not made within the framework of a joint research and development programme but under an agreement having some other principal objective, such as the licensing of intellectual property rights, joint manufacture or specialization, and merely containing ancillary provisions on joint research and development.
