For other taxes and duties on energy the Member States have developed numerous tools, which differ in area of application, methods of calculation and rates, to the detriment of the unity of the internal market.

104. déplore le contenu de l'accord politique du 6 octobre 2015 au sein du Conseil, qui n'est pas à la hauteur de la proposition législative de la Commission présentée en mars 2015 modifiant la directive 2011/16/UE en ce qui concerne l'échange automatique et obligatoire d'informations dans le domaine fiscal; souligne que celle-ci prévoyait, en plus d'un cadre commun en matière d'enregistrement et d'échange automatique d'informations sur les rescrits, des dispositions permettant à la Commission d'en contrôler efficacement la mise en application par les États membres tout en veillant à ce que les rescrits ne portent pas préjudice au marché intérieur; souligne que l'adoption de la position du Conseil empêcherait de tirer pleinement parti de l'échange automatique d'informations sur les rescrits fiscaux, en particulier en termes de mise en œuvre effective, et invite donc le Conseil à s'en tenir à la proposition de la Commission et à tenir dûment compte de l'avis du Parlement sur le sujet, en particulier en ce qui concerne le champ d'application de la directive (tous les rescrits fiscaux et pas seulement les rescrits transfrontaliers), la période de rétroactivité (tous les rescrits fiscaux encore valides seraient échangés) et les informations à fournir à la Commission, qui devrait avoir accès aux rescrits fiscaux;

Deplores the content of the political agreement of 6 October 2015 within the Council, which falls short of the Commission’s legislative proposal of March 2015 amending Directive 2011/16/EU as regards mandatory automatic exchange of information in the field of taxation; stresses that the latter provided, on top of a common framework for the registration and automatic exchange of information on rulings, provisions allowing the Commission to effectively monitor its implementation by Member States and ensure that rulings do not have a negative impact on the internal market; stresses that the adoption of the Council’s position would prevent drawing all benefits from the automatic exchange of rulings, in particular in terms of effective implementation, and calls on the Council, therefore, to stick to the Commission’s proposal and take due account of the Parliament’s opinion thereon, in particular as regards the scope of the directive (all tax rulings instead of cross-border only), the retroactivity period (all tax rulings still valid should be exchanged) and the information provided to the Commission, which should have access to the tax rulings;

V. whereas tax rulings cover a wide range of practices in Member States, ranging from ad-hoc policy to a clearly framed application of the law, in terms of possible scope and topics covered, binding nature, frequency of use, publicity, length and payment of fees; whereas there is no commonly agreed definition of tax rulings at international level except for the Commission’s reference to them as ‘any communication or any other instrument or action with similar effects, by or on behalf of the Member State regarding the interpretation or application of tax laws’;

Il s'agirait d'ajouter ce qui suit: des crédits d'impôt pour la recherche et développement; des mesures fiscales visant à aider les régions ressources; le remplacement des transferts en espèces du fédéral vers les provinces par un transfert équivalent des champs fiscaux; l'impact sur la capacité fiscale des provinces d'une réforme de la péréquation incluant 100 p. 100 des revenus tirés des ressources naturelles, et les mécanismes fiscaux visant à atténuer la disparité dans la croissance est-ouest.
The additional points are as follows: tax credits for research and development; tax measures designed to assist resource areas; replacing federal cash transfers to the provinces with an equivalent transfer of tax fields; the impact on the provinces' fiscal capacity of reforming equalization to include 100% of the taxes from natural resources, and tax mechanisms designed to counteract the disparity in growth between east and west.

À mon avis, les provinces ont donc leur destinée en main et peuvent utiliser ces champs fiscaux comme bon leur semble afin d'offrir à leurs citoyens les services qui leur sont dus en vertu du partage constitutionnel des champs de compétence.
In my opinion, the provinces are in control of their destiny and can use these tax fields as they please, in order to provide their citizens with the services that they are entitled to, under the sharing of jurisdictions provided by the Constitution.
