(3) Le ministre peut dispenser le requérant d’une concession autorisant l’aménagement de forces hydrauliques peu importantes, de se conformer à celles des dispositions du présent règlement dont, de l’avis du ministre, l’application n’est pas nécessaire à cause de la faible puissance de l’aménagement projeté, et le ministre peut octroyer au requérant une concession spéciale, sous réserve des dispositions suivantes :

9. invite instamment les États membres à intégrer l'infrastructure verte et à lui donner la priorité dans le cadre de l'aménagement et du développement du territoire en consultant et en sensibilisant les acteurs de terrain et la population locale avec pédagogie en associant tous les niveaux de décision (local, régional, national), et demande à la Commission de promouvoir des orientations et l'évaluation comparative dans ce domaine afin de garantir que l'infrastructure verte devienne partie intégrante de l'aménagement et du développement du territoire dans l'ensemble de l'Union; souligne que les procédures d'octroi d'autorisation pour de nouveaux développements ou l'infrastructure grise doivent prévoir une évaluation complète de toutes les incidences négatives sur les écosystèmes et l'infrastructure verte existante pour éviter ou atténuer ces incidences et garantir des bénéfices sociétaux réels à long terme;
9. Urges the Member States to integrate and prioritise green infrastructure in spatial and land-use planning by consulting with, and raising awareness among, stakeholders on the ground and local people through education campaigns, involving all decision-taking levels (local, regional and national), and asks the Commission to support guidance and benchmarking in this area in order to ensure that green infrastructure becomes a standard part of spatial planning and territorial development across the Union; points out that permit procedures for new developments or grey infrastructure need to ensure full assessment of any negative impacts on ecosystems and existing green infrastructure in order to avoid and mitigate such impacts and ensure actual long-term societal benefits;
