(b) le demandeur initial bénéficiait, au moment de la première demande, du droit exclusif de faire référence aux preuves scientifiques ou aux données couvertes par la propriété exclusive; et
(b) the initial applicant had exclusive right of reference to the proprietary scientific evidence or scientific data at the time the first application was made; and
