For the purposes of considering the exclusion, on the grounds of his participation in a terrorist organisation, of a person seeking international protection, is the judgment convicting him of being a leading member of a terrorist organisation, which finds that the person seeking international protection has not committed, attempted to commit or threatened to commit a terrorist act, sufficient for a finding of the existence of an act of participation or instigation within the meaning of Article 12(3) of Directive 2004/83/EC imputable to that person, or is it necessary for an individual examination of the facts of the case to be made and participation demonstrated in the commission of a terrorist offence or instigation of a terrorist offence as defined in Article 1 of Framework Decision 2002/475/JHA of 13 June 2002 on combating terrorism?

(13) Afin d’assurer l’égalité de traitement de tous les demandeurs de protection internationale ainsi que la cohérence par rapport à l’acquis actuel de l’UE en matière d’asile, en particulier la directive 2004/83/CE du Conseil du 29 avril 2004 concernant les normes minimales relatives aux conditions que doivent remplir les ressortissants des pays tiers ou les apatrides pour pouvoir prétendre au statut de réfugié ou les personnes qui, pour d’autres raisons, ont besoin d’une protection internationale, et relatives au contenu de ces statuts [17], il convient d’élargir le champ d’application de la présente directive afin d’y inclure les personnes demandant la protection subsidiaire.
13. In view of ensuring equal treatment amongst all applicants for international protection as well as in order to guarantee consistency with current EU asylum acquis , in particular with Council Directive 2004/83/EC of 29 April 2004 on minimum standards for the qualification and status of third country nationals or stateless persons as refugees or as persons who otherwise need international protection and the content of the protection granted[17], it is appropriate to extend the scope of this Directive in order to include applicants for subsidiary protection.

6. Les États membres n’exigent pas des documents de manière inutile ou disproportionnée des demandeurs ou ne les soumettent pas à d’autres formalités administratives, avant de leur accorder les droits qui leur sont conférés par la présente directive, au seul motif que ce sont des demandeurs de protection internationale.
6. Member States shall not impose unnecessary or disproportionate documentation or other administrative requirements on applicants before granting them the rights to which they are entitled under this Directive for the sole reason that they are applicants for international protection.
