À ce titre, l’article 267 du traité sur le fonctionnement de l’UE (TFUE) précise que les juridictions nationales qui statuent en dernier ressort, c’est-à-dire dont les décisions ne peuvent faire l’objet d’un recours, ont l’obligation de saisir la Cour de Justice d'une demande préjudicielle, sauf lorsqu’il existe déjà une jurisprudence de la Cour en la matière ou lorsque l'interprétation de la règle de droit de l'UE en cause est évidente.
In this respect, Article 267 of the Treaty on the Functioning of the EU (TFEU) specifies that national courts which act as a final resort, against whose decisions there is no judicial remedy, are obliged to make a reference to the Court of Justice for a preliminary ruling, unless the Court has already ruled on the matter or the interpretation of the EU rule of law in question is obvious.
