Klaus-Heiner Lehne, membre du Parlement européen, sous peine d’amende à fixer par le Tribunal et, au cas où cette amende ne serait pas payable, de détention d’une durée maximale de six mois (le cas échéant, l’amende s’élèverait à 250 000 euros maximum, la détention à deux ans maximum), de faire dans les colonnes du journal "Bild- Zeitung" certaines déclarations, plus précisément spécifiées par le Tribunal.
On 23 February 2004, without oral proceedings and without hearing the party concerned the Hamburg District Court issued an order, in the form of a temporary injunction, prohibiting Mr Klaus-Heiner Lehne MEP from making certain statements, described in greater detail below, about 'BILD-Zeitung', on pain of a fine for contempt of court and, in the event that payment thereof cannot be enforced, on pain of imprisonment for contempt of court of up to six months (fine for each instance of contempt of court of up to EUR 250 000.00; imprisonment for contempt of court of up to two years in total).
