L'article 40 de l'accord de stabilisation et d'association entre les Communautés européennes et leurs États membres, d'une part, et l'ancienne République yougoslave de Macédoine, d'autre part (ci-après dénommé «accord») fait référence au protocole no 4 (ci-après dénommé «protocole no 4») qui détermine les règles d'origine et prévoit le cumul de l'origine entre l'Union, l'ancienne République yougoslave de Macédoine, la Turquie et tout pays ou territoire participant au processus de stabilisation et d'association de l'Union.
Article 40 of the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and the former Yugoslav Republic of Macedonia, of the other part (‘the Agreement’)refers to Protocol 4 to the Agreement (‘Protocol 4’) which lays down the rules of origin and provides for cumulation of origin between the Union, the former Yugoslav Republic of Macedonia, Turkey and any country or territory participating in the Union's Stabilisation and Association Process.

1. 1. Notwithstanding Article 3 of Appendix I to the Convention, the rules on cumulation provided for in Articles 3 and 4 of this Protocol, as amended by the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and the former Yugoslav Republic of Macedonia, of the other part, to take account of the accession of the Republic of Bulgaria and Romania to the European Union (2), shall continue to apply between the European Union and the former Yugoslav Republic of Macedonia until the Convention has entered into application with relation to all Contracting Parties listed in Articles 3 and 4 of this Protocol.

The new Convention on pan-Euro-Mediterranean preferential rules of origin brings together all the various rules of origin of goods traded under the relevant trade agreements concluded between the following parties: the European Union, the participants in the Barcelona Process (Algeria, Egypt, Israel, Jordan, Lebanon, Morocco, Syria, Tunisia, Turkey and the Palestinian Authority), the EFTA States (Iceland, Norway, Switzerland and Liechtenstein), the Faroe Islands and the participants in the Stabilisation and Association Process (Albania, Bosnia and Herzegovina, Croatia, the former Yugoslav Republic of Macedonia, Montenegro and Serbia, as well as Kosovo under UNSC Resolution 1244/99), thus facilitating the use of Pan-Euromed cumulation of origin by adopting one single and simplified instrument.

Where unlawful aid has previously been granted to the firm in difficulty, in respect of which the Authority has adopted a negative decision with a recovery order, and where no such recovery has taken place in compliance with Article 14 in Part II of Protocol 3 to the Agreement between the EFTA States on the establishment of a Surveillance Authority and a Court of Justice (hereinafter the Surveillance and Court Agreement) (10), the assessment of any rescue and restructuring aid to be granted to the same undertaking shall take into account, first, the cumulative effect of the old aid and of the new aid and, secondly, the fact that the old aid has not been repaid (11).

A zone of diagonal cumulation of origin will be established between the EU and the countries of region that have concluded free trade agreements with the EU (currently Croatia and the former Yugoslav Republic of Macedonia), as a first step before the inclusion of the region in the Pan-Euro-Med System.

2) La Communauté se déclare prête à considérer l'octroi du cumul de l'origine à ceux des États issus de l'ancienne République fédérative socialiste de Yougoslavie qui auront rétabli des relations normales de coopération économique et commerciale et dès que la coopération administrative indispensable au bon fonctionnement d'un tel cumul aura été instituée.
2. The Community is prepared to grant cumulation of origin to the States that emerged from the former Socialist Federal Republic of Yugoslavia which have restored normal economic and trade cooperation as soon as the administrative cooperation needed for cumulation to work properly has been established.
