Étant donné qu'au printemps 2003, la Commission n'a pas pu, sur la base de sa propre analyse, dissiper les doutes qui subsistaient quant à la viabilité de la banque à la suite de l'échec de la privatisation et du résultat global très négatif de 2002 et étant donné que selon l'Allemagne, il n'était pas possible d'isoler effectivement les risques de crédit inhérents principalement au financement immobilier sans nouvelles aides, la Commission s'est assurée avec l'aide d'experts indépendants que, sauf sur certains points, la banque avait pris les mesures adéquates pour couvrir les risques existants et qu'elle avait constitué les provisions nécessaires.
Since the Commission was unable in the spring of 2003 to allay, on the basis of its own analysis, the remaining doubts as to the bank’s viability raised by the failure of the privatisation process and the strongly negative aggregate result for 2002 and since a suitable, effective insulation of the credit risks existing above all in the real estate financing field was, according to Germany, impossible to achieve without further aid, the Commission made sure with the help of independent experts that, apart from a few points, the bank had made adequate provision for the existing risks and had built up suitable reserves.
