Afin de préserver les intérêts des créanciers d’aliments et de favoriser une bonne administration de la justice au sein de l’Union européenne, les règles relatives à la compétence telles qu’elles résultent du règlement (CE) no 44/2001 devraient être adaptées.
In order to preserve the interests of maintenance creditors and to promote the proper administration of justice within the European Union, the rules on jurisdiction as they result from Regulation (EC) No 44/2001 should be adapted.

D’autre part, ces règles ne sont pas adaptées aux besoins spécifiques des créanciers d’aliments. (14) The law of the country of the habitual residence of the maintenance creditor should remain predominant , as in the existing international instruments, but the law of the forum should come in second rank, because it often allows, in this specific area, to resolve disputes in a simpler, faster and less expensive manner.

Elle reconnaît qu’un champ d’application étendu à toutes les obligations alimentaires découlant de relations de famille, de filiation, de mariage ou d’alliance est susceptible d’augmenter de façon considérable l’effet utile de la convention en faisant bénéficier du système de coopération administrative instauré par la convention tous les créanciers d’aliments.
The Union recognises that extending the application of the Convention to all maintenance obligations arising from a family relationship, parentage, marriage or affinity is likely to increase considerably its effectiveness, allowing all maintenance creditors to benefit from the system of administrative cooperation established by the Convention.
