IN-CONTEXT TRANSLATIONS

Étant donné que les règles établies dans le présent règlement déterminent les conditions d'application de la méthode définie dans le règlement délégué (UE) 2015/63 adopté en application de l'article 103, paragraphe 7, de la directive 2014/59/UE, les différences entre le calcul par le CRU des contributions annuelles des établissements agréés dans les États membres participants et le calcul des contributions annuelles dans les États membres qui ne participent pas au MRU ne devraient refléter que les spécificités du système unifié applicable dans les États membres participants.
As the rules laid down in this Regulation determine conditions for the application of the methodology set out in Delegated Regulation (EU) 2015/63 adopted pursuant to Article 103(7) of Directive 2014/59/EU, the differences between the calculation of the annual contributions by the Board for the institutions authorised in the participating Member States and the calculation of the annual contributions in the Member States which are not participating in the SRM should reflect only the specificities of a unified system in the participating Member States.

Considering that Article 70(7) of Regulation (EU) No 806/2014 empowers the Board to calculate the contributions of institutions to the Single Resolution Fund which would replace the financing arrangements of the participant Member States in the Single Resolution Mechanism as of 1 January 2016 by applying this Regulation based on Article 103(7) of Directive 2014/59/EU, the notion of resolution authority under this Regulation should also include the Board.

3. Par dérogation au paragraphe 1 du présent article, les décisions visées à l'article 50, paragraphe 1, concernant la perception de contributions ex post conformément à l'article 71, les emprunts volontaires entre dispositifs de financement conformément à l'article 72, les moyens de financement alternatifs conformément aux articles 73 et 74, ainsi que la mutualisation des dispositifs nationaux de financement conformément à l'article 78, au-delà des moyens financiers disponibles dans le Fonds, sont prises à la majorité des deux tiers des membres du CRU représentant au moins 50 % des contributions pendant la période transitoire de huit ans avant la pleine mutualisation du Fonds, et à la majorité des deux tiers des membres du CRU représentant au moins 30 % des contributions après cette période.
3. By way of derogation from paragraph 1 of this Article, decisions referred to in Article 50(1), which involve the raising of ex-post contributions in accordance with Article 71, on voluntary borrowing between financing arrangements in accordance with Article 72, on alternative financing means in accordance with Article 73 and Article 74, as well as on the mutualisation of national financing arrangements in accordance with Article 78, exceeding the use of the financial means available in the Fund, shall be taken by a majority of two thirds of the Board members, representing at least 50 % of contributions during the eight-year transitional period until the Fund is fully mutualised and by a majority of two thirds of the Board members, representing at least 30 % of contributions from then on.

With respect to the Fund, the Board will have to levy annual contributions on almost 6,000 institutions, will have to make sure that the contribution basis in individual banks is correctly determined, that the contributions are paid on time and that unpaid amounts are effectively recovered. To this end, the Board will conduct inspections of bank records.

The information referred to in points i to v above shall be in addition to the monthly reports on whether the conditions for the transfer of contributions to the Fund have been met, which the Board shall submit in accordance with the first subparagraph of Article 99(6) of the SRM Regulation and, where applicable, to the monthly reports issued in accordance with the second subparagraph of Article 99(6) of the SRM Regulation where the conditions for the transfer of the contributions have not been met.

The Commission should be empowered to adopt delegated acts in accordance with Article 290 TFEU in order to determine the rules for the calculation of the interest rate to be applied in the event of a decision on the recovery of misused amounts from the Fund and to guarantee the rights to good administration and of access to documents of beneficiaries in procedures in respect of such a recovery; determine the type of contributions to the Fund and the matters for which contributions are due, and the manner in which the amount of the contributions is calculated and the way in which they are to be paid; specify registration, accounting, reporting and other rules necessary to ensure that the contributions are paid fully and in a timely manner; determine the annual contributions necessary to cover the administrative expenditure of the Board before it becomes fully operational; determine the contribution system for institutions that have been authorised to operate after the Fund has reached its target level; determine the criteria for the spreading out in time of the contributions; determine the criteria for determining the number of years by which the initial period for reaching the target level can be extended; determine the criteria for establishing the annual contributions when the available financial means of the Fund diminishes below its target level after the initial period; determine the measures to specify the circumstances and conditions under which ex-post contributions may be temporarily deferred for individual institutions; and determine the detailed rules for the administration of the Fund and general principles and criteria for its investment strategy.
