National regulatory authorities shall, based on the cross-border cost allocation as referred to in paragraph 4 of this Article, take into account actual costs incurred by a TSO or other project promoter as a result of the investments when fixing or approving tariffs in accordance with Article 37(1)(a) of Directive 2009/72/EC and Article 41(1)(a) of Directive 2009/73/EC, insofar as these costs correspond to those of an efficient and structurally comparable operator.

(20) Except as otherwise provided in subsections 11(10), 12(11) and 13(10), where the producer of a good has calculated the regional value content of the good under the net cost method on the basis of estimated costs, including standard costs, budgeted forecasts or other similar estimating procedures, before or during the period chosen under paragraph (15)(a), the producer shall conduct an analysis at the end of the producer’s fiscal year of the actual costs incurred over the period with respect to the production of the good and, if the good does not satisfy the regional value-content requirement on the basis of the actual costs during that period, immediately inform any person to whom the producer has provided a Certificate of Origin for the good, or a written statement that the good is an originating good, that the good is a non-originating good.

The Council and the Commission agree that the costs determined and paid by the beneficiary based on these unit costs established through public procurement procedures shall constitute real costs actually incurred and paid by the beneficiary under Article 67 (1) (a).

3. Afin de permettre de rendre compte de la réalisation des objectifs de performance conformément à l’article 18, paragraphe 4, du règlement d'exécution (UE) no 390/2013, les États membres mettent à la disposition de la Commission et d’Eurocontrol, pour le 1er juin de chaque année, leurs coûts réels supportés au cours de l’année précédente et la différence entre les coûts réels et les coûts fixés figurant dans le plan de performance, en utilisant les tableaux de déclaration et les modalités figurant aux annexes II, VI et VII. Les États membres qui ont décidé que des services de navigation aérienne terminaux ou des services CNS, MET et AIS sont soumis aux conditions du marché conformément à l’article 3 communiquent ces informations en utilisant les tableaux de déclaration et les modalités figurant à l’annexe III.
3. In order to allow reporting on the achievement of performance as established in Article 18(4) of Implementing Regulation (EU) No 390/2013, Member States shall make available to the Commission and Eurocontrol, by 1 June of each year, their actual costs incurred during the previous year and the difference between the actual costs and the determined costs contained in the performance plan by making use of the reporting tables and detailed rules set out in Annexes II, VI and VII. Those Member States that have decided that terminal air navigation services or CNS, MET and AIS services are subject to market conditions in accordance with Article 3 shall provide this information by making use of the reporting tables and detailed rules set out in Annex III.
