TRADUCTIONS EN CONTEXTE

En interprétant l’expression « mesures d’exécution » visée à l’article 12, paragraphe 3, de la directive 76/308/CEE, et reflétée à présent à l’article 14, paragraphe 2, de la directive 2010/24/UE, la Cour a indiqué que, conformément à l’article 5 de la directive 76/308/CEE, reflété à présent à l’article 8 de la directive 2010/24/UE, la première étape de l’exécution du recouvrement dans le cadre de l’assistance mutuelle est la notification au destinataire, par l’autorité requise, de tous actes et décisions relatifs à une créance ou à son recouvrement, émanant de l’État membre où l’autorité requérante a son siège, ladite notification devant être effectuée sur le fondement des renseignements fournis par l’autorité requérante . Il en résulte que la notification constitue une des mesures d’exécution visées à l’article 12, paragraphe 3, de la directive 76/308/CEE et que, dès lors, conformément à cette disposition, c’est devant l’instance compétente de l’État membre où l’autorité requise a son siège que doit être portée toute action dirigée contre la notification .
In interpreting the words ‘enforcement measures’ in Article 12(3) of Directive 76/308, which is now reflected in Article 14(2) of Directive 2010/24, the Court noted that, pursuant to Article 5 of Directive 76/308, now reflected in Article 8 of Directive 2010/24, the first stage of enforcement in the context of mutual assistance is notification to the addressee by the requested authority of all instruments and decisions which emanate from the Member State in which the applicant authority is situated and which relate to a claim and/or to its recovery, the notification having to be carried out on the basis of the information supplied by the applicant authority It followed that notification constitutes one of the enforcement measures referred to in Article 12(3) of Directive 76/308 and that, therefore, in accordance with that provision, it is before the competent body of the Member State in which the requested authority is situated that any action challenging that notification is to be brought

La Cour a indiqué ensuite que les indices suivants constituent des éléments permettant de conclure à l'imputabilité à l'État d'une mesure d'aide prise par une entreprise publique: i) le fait que l'entreprise en question ne pouvait pas prendre la décision contestée sans tenir compte des exigences des pouvoirs publics; ii) le fait que, outre des éléments de nature organique qui liaient les entreprises publiques à l'État, l'entreprise publique par l'intermédiaire de laquelle l'aide a été accordée doit tenir compte des directives émanant d'un organe gouvernemental central, en l'espèce le Comitato interministeriale per la programmazione economica (CIPE); iii) l'intégration de l'entreprise publique dans les structures de l'administration publique; iv) la nature des activités de l'entreprise et l'exercice de celles-ci sur le marché dans des conditions normales de concurrence avec des opérateurs privés; v)le statut juridique de l'entreprise (c'est-à-dire le fait de relever du droit public ou du droit commun des sociétés); vi)l'intensité de la tutelle exercée par les autorités publiques sur la gestion de l'entreprise ou vii)tout autre indice indiquant, dans le cas concret, une implication des autorités publiques ou l'improbabilité d'une absence d'implication dans l'adoption d'une mesure, eu égard également à l'ampleur de celle-ci, à son contenu ou aux conditions qu'elle comporte.
Subsequently, the Court has indicated the following indicators allowing to infer the imputability to the State of a measure taken by a public undertaking: (i) the fact that the undertaking in question could not take the contested decision without taking account of the requirements of the public authorities; (ii) the fact that, apart from factors of an organic nature which linked the public undertakings to the State, a public undertaking, through the intermediary of which aid had been granted, had to take account of directives issued by a central government body, i.e. Comitato Interministeriale per la Programmazione Economica (CIPE); (iii) integration of the public undertaking to the structures of the public administration of the State; (iv) the nature of the undertaking's activities and whether such activities are exercised out on the market in normal conditions of competition with private operators; (v) the legal status of the undertaking (in the sense of its being subject to public law or ordinary company law); (vi) the intensity of the supervision exercised by the public authorities over the management of the undertaking, or (vii) any other indicator showing, in the particular case, an involvement by the public authorities in the adoption of a measure or the unlikelihood of their not being involved, having regard also to the compass of the measure, its content or the conditions which it contains.

When it has doubts about the validity of such an act, a court or tribunal of a Member State must therefore refer the matter to the Court, stating the reasons for which it considers that the act is invalid.

La Cour a indiqué également, audit point de cet arrêt, qu’une telle conception répond aux traditions juridiques communes aux États membres et se retrouve également dans l’ordre juridique de l’Union, ainsi qu’il résulte des dispositions de l’article 19 du statut de la Cour de justice.
The Court also held, in paragraph 24, that such a conception reflects the legal traditions common to the Member States and is also to be found in the legal order of the European Union, as is demonstrated by the provisions of Article 19 of the Statute of the Court of Justice.
