1. Sauf disposition contraire du règlement d’application, lorsqu’une personne est admissible au bénéfice d’une prestation ou est tenue au paiement d’une cotisation conformément au règlement de base, et que l’institution compétente ne dispose pas de l’ensemble des éléments concernant la situation dans un autre État membre permettant d’effectuer le calcul définitif du montant de cette prestation ou cotisation, ladite institution procède à la liquidation provisoire de cette prestation à la demande de la personne concernée, ou au calcul provisoire de cette cotisation si ce calcul est possible à partir des éléments dont elle dispose.
1. Unless otherwise provided for in the implementing Regulation, where a person is eligible for a benefit, or is liable to pay a contribution in accordance with the basic Regulation, and the competent institution does not have all the information concerning the situation in another Member State which is necessary to calculate definitively the amount of that benefit or contribution, that institution shall, on request of the person concerned, award this benefit or calculate this contribution on a provisional basis, if such a calculation is possible on the basis of the information at the disposal of that institution.

5. Si nécessaire, l’institution reconnue comme compétente et l’institution ayant versé des prestations en espèces à titre provisoire ou ayant perçu des cotisations à titre provisoire règlent la situation financière de la personne concernée au regard des cotisations et des prestations en espèces versées à titre provisoire, le cas échéant en conformité avec le titre IV, chapitre III, du règlement d’application.
5. If necessary, the institution identified as being competent and the institution which provisionally paid the cash benefits or provisionally received contributions shall settle the financial situation of the person concerned as regards contributions and cash benefits paid provisionally, where appropriate, in accordance with Title IV, Chapter III, of the implementing Regulation.

À la demande de l’institution reconnue comme compétente, introduite au plus tard trois mois après avoir établi quelle est la législation applicable, l’institution ayant perçu des cotisations à titre provisoire les transfère à l’institution reconnue comme compétente pour la période correspondante en vue de régler la situation relative aux cotisations dues par une personne physique et/ou morale.
Upon request of the institution identified as being competent, which shall be made at the latest three months after the applicable legislation has been determined, the institution that has provisionally received contributions shall transfer them to the institution identified as being competent for that period for the purpose of settling the situation concerning the contributions owed by the legal and/or natural person to it.

where an outgoing worker has not yet acquired vested pension rights when the employment relationship is terminated, the supplementary pension scheme shall reimburse the contributions paid by the outgoing worker, or paid on behalf of the outgoing worker, in accordance with national law or collective agreements or contracts, or, where the outgoing worker bears the investment risk, either the sum of the contributions made or the investment value arising from these contributions.

7. La législation allemande sur les accidents de travail et maladies professionnelles à indemniser au titre de la loi relative aux droits à pension acquis par cotisation à l'étranger et pour les prestations pour les périodes d'assurance qui peuvent être assimilées au titre de la loi relative aux droits à pension acquis par cotisation à l'étranger dans les territoires cités au paragraphe 1(2)(3) de la Bundesvertriebenengesetz (loi sur les affaires des personnes déplacées et réfugiés) reste d'application dans le cadre de l'application du règlement nonobstant les dispositions du paragraphe 2 de la Fremdrentengesetz (loi relative aux droits à pension acquis par cotisation à l'étranger).
7. The German legislation on accidents at work and occupational diseases to be compensated for under the law governing foreign pensions and for benefits for insurance periods which can be credited under the law governing foreign pensions in the territories named in paragraph 1(2)(3) of the Bundesvertriebenengesetz (Law on displaced persons and refugees) continues to apply within the scope of application of this Regulation notwithstanding the provisions of paragraph 2 of the Fremdrentengesetz (Law on foreign pensions).

6a. The German legislation on accidents at work and occupational diseases to be compensated for under the law governing foreign pensions and for benefits for insurance periods which can be credited under the law governing foreign pensions in the territories named in paragraph 1(2)(3) of the Act on affairs of displaced persons and refugees (Bundesvertriebenengesetz) continues to apply within the scope of application of the Regulation notwithstanding the provisions of paragraph 2 of the Act on foreign pensions (Fremdrentengesetz).

Lorsque pour une campagne de commercialisation, la perte globale constatée en application de l'article 15, paragraphes 1 et 2, n'est pas entièrement couverte par les recettes des cotisations à la production au titre de cette même campagne après application de l'article 15, paragraphes 3, 4 et 5, une cotisation complémentaire est perçue des fabricants, sans préjudice de l'article 4, pour couvrir intégralement la partie de la perte globale en cause non couverte par lesdites recettes.
1. Where the overall loss recorded for a particular marketing year under Article 15(1) and (2) is not fully covered by the proceeds from the production levies for that marketing year after application of Article 15(3), (4) and (5), an additional levy shall be charged to manufacturers, without prejudice to Article 4, to cover the outstanding balance of the overall loss.
