TRADUCTIONS EN CONTEXTE

Le règlement no 1083/2006, lu en combinaison avec l’article 47 de la charte des droits fondamentaux de l’Union européenne doit être interprété en ce sens qu’il s’oppose à une disposition d’un manuel de programme adopté par un comité de suivi dans le cadre d’un programme opérationnel conclu entre deux États membres et visant à promouvoir la coopération territoriale européenne, en tant que cette disposition ne prévoit pas qu’une décision de ce comité de suivi rejetant une demande de subvention puisse faire l’objet d’un recours devant une juridiction d’un État membre.
Regulation No 1083/2006, read in conjunction with Article 47 of the Charter of Fundamental Rights of the European Union, must be interpreted as precluding a provision of a programme manual adopted by a monitoring committee in the context of an operational programme established by two Member States and intended to promote European territorial cooperation, where that provision does not provide that a decision of the monitoring committee rejecting an application for aid can be subject to appeal before a court of a Member State.

L’article 263 TFUE doit être interprété en ce sens que, dans le cadre d’un programme opérationnel relevant des règlements (CE) nos 1083/2006 du Conseil, du 11 juillet 2006, portant dispositions générales sur le Fonds européen de développement régional, le Fonds social européen et le Fonds de cohésion, et abrogeant le règlement (CE) no 1260/1999, et 1080/2006 du Parlement européen et du Conseil, du 5 juillet 2006, relatif au Fonds européen de développement régional et abrogeant le règlement (CE) no 1783/1999, et visant à promouvoir la coopération territoriale européenne, un recours contre une décision d’un comité de suivi rejetant une demande de subvention ne relève pas de la compétence du Tribunal de l’Union européenne.
Article 263 TFEU must be interpreted as meaning that, in the context of an operational programme under Council Regulation (EC) No 1083/2006 of 11 July 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260/1999, and Regulation (EC) No 1080/2006 of the European Parliament and of the Council of 5 July 2006 on the European Regional Development Fund and repealing Regulation (EC) No 1783/1999 and intended to promote European territorial cooperation, an action against a decision of a monitoring committee rejecting an application for aid does not fall within the jurisdiction of the General Court of the European Union.

L’article 267, premier alinéa, sous b), TFUE doit être interprété en ce sens qu’un manuel de programme adopté par un comité de suivi dans le cadre d’un programme opérationnel relevant des règlements nos 1083/2006 ainsi que 1080/2006 et visant à promouvoir la coopération territoriale européenne entre deux États membres, tel que celui en cause dans l’affaire au principal, ne constitue pas un acte pris par une institution, un organe ou un organisme de l’Union et, en conséquence, la Cour de justice de l’Union européenne n’est pas compétente pour apprécier la validité des dispositions d’un tel manuel.
Point (b) of the first paragraph of Article 267 TFEU must be interpreted as meaning that a programme manual adopted by a monitoring committee in the context of an operational programme under Regulations No 1083/2006 and No 1080/2006 and intended to promote European territorial cooperation between two Member States, such as that at issue in the main proceedings, does not constitute an act of an institution, body, office or agency of the European Union and, in consequence, the Court of Justice of the European Union does not have jurisdiction to review the validity of the provisions of such a manual.

Due to the involvement of more than one Member State, the general rule laid down in Regulation (EU) No 1303 /2013, whereby each Member State is to adopt national rules on eligibility of expenditure, is not appropriate for the European territorial cooperation goal.

Le règlement (CE) no 1082/2006 ne pouvant s'appliquer dans les pays tiers, l'État membre dans lequel le siège proposé pour le GECT doit se situer devrait, lorsqu'il approuve la participation de membres potentiels issus de pays tiers, constitués selon le droit de ces pays tiers, s'assurer, en concertation avec les autres États membres concernés, à savoir les États membres dont le droit régit la constitution d'autres membres potentiels du GETC, que les pays tiers ont appliqué des conditions et procédures équivalentes à celles fixées dans le règlement (CE) no 1082/2006 ou se sont conformés aux accords internationaux bilatéraux ou multilatéraux conclus entre les États membres du Conseil de l'Europe, qu'il s'agisse ou non d'États membres de l'Union, sur la base de la convention-cadre européenne sur la coopération transfrontalière des collectivités ou autorités territoriales, signée à Madrid le 21 mai 1980, et des protocoles additionnels adoptés en application de celle-ci.
As Regulation (EC) No 1082/2006 cannot apply in third countries, the Member State where the proposed registered office of the EGTC is to be located should, when approving the participation of prospective members from third countries, established under the law of those third countries, satisfy itself, in consultation with those Member States under whose laws other prospective members of the EGTC have been established, that the third countries have applied equivalent conditions and procedures to those laid down in Regulation (EC) No 1082/2006 or acted in accordance with international bilateral or multilateral agreements concluded between Member States of the Council of Europe, whether or not they are also Member States of the Union, based on the European Outline Convention on Transfrontier Co-operation between Territorial Communities or Authorities, signed in Madrid on 21 May 1980, and the additional Protocols adopted pursuant thereto.

Stresses that only with genuinely integrated multi-level governance among local, regional, national, cross-border and EU public authorities can EU, national and regional policy be efficient and effective; calls on the Commission to evaluate the possibilities of innovation-related territorial cooperation, both national and international, in each cohesion policy objective, and to analyse the possibilities for reinforcing the European territorial cooperation objective with regard to fostering innovation-related cooperation between regions; in parallel with the reinforcement of the Territorial Cooperation Objective (Objective 3), the possibility of developing transnational territorial cooperation actions in the framework of Objective 2 should also be reinforced; notes that such a possibility is now made possible by Article 37(6)(b) of Regulation (EC) No 1083/2006; is of the opinion that, without changing the overall cohesion objectives’ budget, the reinforcement of territorial cooperation should be accompanied by a move towards an increased budget for this extended territorial cooperation;
