Regrets that, under Article 10 of the Protocol on transitional provisions annexed to the Treaty of Lisbon, the powers of the Court of Justice with respect to acts in the field of police cooperation and judicial cooperation in criminal matters adopted before the entry into force of that Treaty are to remain the same as they are under the present EU Treaty for a transitional period of five years; welcomes, however, the declaration made by the Intergovernmental Conference concerning that article of the Protocol and accordingly urges the Council and the Commission to join with Parliament in re-adopting those acts in the field of police cooperation and judicial cooperation in criminal matters which were adopted before the entry into force of the Lisbon Treaty;

As a transitional measure, and with respect to acts of the Union in the field of police cooperation and judicial cooperation in criminal matters which have been adopted before the entry into force of the Treaty of Lisbon, the powers of the institutions shall be the following at the date of entry into force of that Treaty: the powers of the Commission under Article 258 of the Treaty on the Functioning of the European Union shall not be applicable and the powers of the Court of Justice of the European Union under Title VI of the Treaty on European Union, in the version in force before the entry into force of the Treaty of Lisbon, shall remain the same, including where they have been accepted under Article 35(2) of the said Treaty on European Union.

In particular, acts of the Union in the field of police cooperation and judicial cooperation in criminal matters adopted before the entry into force of the Treaty of Lisbon which are amended shall continue to be binding upon and applicable to Denmark unchanged.

En outre, le traité de Lisbonne a créé une nouvelle base juridique pour l'adoption de la législation relative à la protection des données à caractère personnel, et la Charte des droits fondamentaux a consacré le droit à la protection des données à caractère personnel en tant que droit fondamental s'appliquant également à la coopération policière et judiciaire en matière pénale.
Furthermore, the Treaty of Lisbon has put in place a new legal basis for the adoption of personal data protection legislation with regard to the processing of personal data and the Charter of Fundamental Rights has acknowledged the right to the protection of personal data as a fundamental right which also applies to police cooperation and judicial cooperation in criminal matters.
