B. whereas the verdict of the court of first instance was delivered on 12 May 2014, sentencing Meriam Ibrahim, then eight months pregnant, to a hundred lashes on charges of adultery and to death by hanging on charges of apostasy, but giving her three days to renounce Christianity; whereas Meriam Ibrahim was convicted under Islamic sharia law, in force in Sudan since 1983, which outlaws conversions on pain of death; whereas on 15 May 2014 the verdict was reconfirmed, as Meriam Ibrahim chose not to convert to Islam;

E. considérant que le vice-ministre de la justice de la République d'Azerbaïdjan, Vilayat Zahirov, a adressé le 15 août 2012 une lettre officielle au ministère de l'administration publique et de la justice de Hongrie, dans laquelle il faisait observer qu'il avait été procédé, en conformité avec l'article 9, paragraphe 1 a), de la convention et sans convertir les condamnations, à l'exécution des décisions, prises par des juridictions étrangères, concernant le transfert de personnes condamnées, afin que ces dernières puissent purger le restant de leur peine d'emprisonnement en République d'Azerbaïdjan; qu'il a par ailleurs donné l'assurance que, conformément au code pénal de la République d'Azerbaïdjan, la sanction visant un condamné purgeant une peine de prison à vie ne pouvait être remplacée que par une peine d'emprisonnement d'une durée déterminée fixée par une juridiction, et que le condamné ne pouvait bénéficier d'une liberté conditionnelle qu'après avoir au moins purgé 25 ans de sa peine; que les autorités azerbaïdjanaises ont donc refusé de donner toute assurance diplomatique à leurs homologues hongroises;
E. whereas the Deputy Minister of Justice of the Republic of Azerbaijan, Vilayat Zahirov, sent an official letter to the Ministry of Public Administration and Justice of Hungary on 15 August 2012, in which he stated that the execution of the decisions of foreign states’ courts regarding the transfer of sentenced persons to serve the remaining part of their prison sentences in the Republic of Azerbaijan were carried out in accordance with Article 9(1)(a) of the convention, without any conversion of their sentences; whereas he further gave an assurance that, according to the Criminal Code of the Republic of Azerbaijan, the punishment of a convict serving a life sentence could only be replaced by a court with a term of imprisonment for a specified period, and that the convict could be released on conditional parole only after serving at least 25 years of his or her prison sentence; and whereas the Azerbaijani authorities subsequently denied having given any diplomatic assurances to the Hungarian authorities;

If the administering State adopts the procedure of conversion of the penalty, that State (a) will be bound by the findings as to the facts in so far as they appear explicitly or implicitly in the judgment handed down in the sentencing State; (b) may, unless it has made a declaration to the contrary, convert a custodial penalty into a financial penalty if the penalty is less than or equal to a period of six months; and (c) may not aggravate the penal position of the sentenced person and will not be bound by any minimum penalty which its own law may provide for the offence or offences committed (Article 8(5)).

Where the transfer of enforcement of a custodial penalty is accepted, the competent authorities in the administering State must either enforce the penalty imposed in the sentencing State - immediately or through an order - or through a judicial or administrative procedure convert the sentence into a decision of the administering State, thereby substituting the penalty imposed in the sentencing State by a penalty laid down by the law of the administering State for the same offence (Article 8).

The Council of Europe Conventions of 30 November 1964 and 21 March 1983 and the Convention between the Member States of the European Communities of 13 November 1991 give the State of enforcement a choice [141] between adapting the penalty to be recognised into the penalty provided for by its own legislation for comparable offences (Conventions of 1964, 1983 and 1991) and the possibility of substituting for the penalty ordered in the State of judgment a penalty provided for by its own legislation for the same offence (Conventions of 1964 and 1970) or converting the penalty ordered in the State of judgment into a penalty provided for by its own legislation for the same offence (Conventions of 1983 and 1991).
