TRADUCTIONS EN CONTEXTE

(1.2) Lorsqu’un contribuable dispose d’un bien pour un produit de disposition, déterminé compte non tenu du présent paragraphe, au moins égal à la juste valeur marchande du bien au moment de la disposition, et qu’il existe, à ce moment, une convention selon laquelle une personne avec qui le contribuable a un lien de dépendance convient de payer, à titre de loyer, redevance ou autre paiement pour l’usage ou le droit d’usage du bien, un montant inférieur à ce qui aurait été raisonnable dans les circonstances si le contribuable et la personne n’avaient eu aucun lien de dépendance au moment de la conclusion de la convention, le produit de disposition du bien est réputé égal au plus élevé des montants suivants :
(b) there existed at that time an agreement under which a person with whom the taxpayer was not dealing at arm’s length agreed to pay as rent, royalty or other payment for the use of or the right to use the property an amount less than the amount that would have been reasonable in the circumstances if the taxpayer and the person had been dealing at arm’s length at the time the agreement was entered into,

7. Takes the view that the Convention would have been greatly enhanced by the inclusion of a single, efficient dispute-settlement mechanism that would make for speedy and satisfactory resolution of disputes concerning the origin and the cumulation of products; invites the Commission to assess the possibility of integrating such a mechanism into the Convention when it is revised in the future;

(15) Il ne peut être fait droit à une réclamation concernant une contrefaçon de brevet qui s’est produite de bonne foi pendant la période où le brevet a été tenu secret sous le régime du présent article. Quiconque, avant la publication de ce brevet, avait accompli de bonne foi un acte qui, sans le présent paragraphe, aurait donné lieu à une telle réclamation, a droit, après la publication en question, d’obtenir une licence pour fabriquer, utiliser et vendre l’invention brevetée aux termes qui, en l’absence de convention entre les parties, peuvent être arrêtés par le commissaire ou par la Cour fédérale sur appel de la décision du commissaire.
(15) No claim shall be allowed in respect of any infringement of a patent that occurred in good faith during the time that the patent was kept secret under this section, and any person who, before the publication of the patent, had in good faith done any act that, but for this subsection would have given rise to a claim, is entitled, after the publication, to obtain a licence to manufacture, use and sell the patented invention on such terms as may, in the absence of agreement between the parties, be settled by the Commissioner or by the Federal Court on appeal from the Commissioner.

We are well aware that the Intergovernmental Conference is not going to be forced to choose between these options and that it could very well decide to choose another option, to come up with something else, to give these options a different response to the one that the Convention would have given.

Reference may in particular be made, in that connection, to the obligation imposed on the parties to the Convention to establish the import regime applicable to the products that are subject to that procedure (Article 10(1) to (5)), the disclosure of the essential elements of that regime to any natural or legal person with an interest (Article 10(8)) or the obligation imposed on exporting parties to ensure compliance by exporters within their jurisdiction with the regimes laid down by the importing parties and, in particular, to prohibit, subject to clearly circumscribed exceptions, any export of the products listed in Annex III to the Convention to a party to the Convention which has not notified to the secretariat the import regime applicable to those products or has merely notified to it an interim response not containing a decision concerning the interim import regime (Article 11(1)(b) and (2)).
