Where the same method of detection and identification has already been included in a previous application by the same applicant for products related to the same GMO and that method has been validated and published by the CRL or its validation is pending, that applicant shall be exempted from the payment of the financial contributions referred to Article 3.

3. Where the costs of the validation of the detection method proposed by the applicant exceed substantially the amount of the financial contributions mentioned under paragraphs 1 and 2, an additional contribution shall be requested.

« (3.01) Lorsqu'un contribuable a versé, au cours d'une année d'imposition, une contribution monétaire visée au paragraphe (3) et qu'il ne peut se prévaloir de la déduction visée à ce paragraphe du fait qu'il n'est pas tenu de payer de l'impôt pour cette année, le contribuable a le droit de recevoir un remboursement de sa contribution monétaire correspondant au montant calculé en vertu de la formule visée aux alinéas 3a) à c), s'il se conforme par ailleurs à l'obligation de fournir les reçus requis en vertu du paragraphe (3)».
" (3.01) Where a taxpayer has made a monetary contribution in the year to a registered party or to a candidate whose nomination has been confirmed in an election of a member or members to serve in the House of Commons of Canada and the taxpayer cannot deduct the monetary contribution under that subsection because there was no income tax payable by the taxpayer in the year, the taxpayer is entitled to receive a refund, in respect of the monetary contribution corresponding to an amount calculated in accordance with the formula set out in paragraphs (3)(a) to (c), provided the taxpayer has filed a receipt in respect of each monetary contribution with the Minister as required under subsection (3)" .
