As mentioned in some contributions the forthcoming ruling of the Court of First Instance [42] in relation to Article 3a might provide new elements that could necessitate a further discussion of "guiding principles" or the role of the Commission.

The Commission therefore notes that the national court's conclusion was limited to the application of national constitutional law, and in particular to the interpretation of the legal concept of the ‘special contribution’.

Thus, the State’s contribution can be deemed to be in line with recent case-law in this area, and in particular with the judgment of the Court of First Instance in Combus (11) according to which freeing a public-sector company from structural disadvantages as compared to its private-sector competitors, such as those due to the ‘privileged and costly status of officials’, does not constitute State aid.
