Les États membres définissent les critères applicables à la fixation du montant de la contrepartie financière prévue au point b), qui peut varier en fonction du futur produit final des vignobles concernés et de la période transitoire résiduelle durant laquelle l'interdiction des nouvelles plantations prévue à l'article 90, paragraphes 1 et 2, s'applique.
Member States shall define the criteria for setting the amounts of the payment referred to in (b), which may vary depending on the final intended product of the vineyards concerned and on the residual transitional period during which the prohibition on new plantings as provided for in Article 90(1) and (2) applies.

The Fisheries Partnership Agreement between the European Community on the one hand, and the Government of Denmark and the Home Rule Government of Greenland, on the other hand , and the Protocol setting out the fishing opportunities and financial contribution provided for in that Agreement , provide that the Union is to receive 7,7 % of the total available catches (TAC) for capelin in Greenland waters of ICES zones V and XIV.

1. Les contreparties financières au sens de l’article 2, paragraphe 8, du règlement (UE) no 648/2012, et les contreparties non financières remplissant les conditions visées à l’article 10, paragraphe 1, point b), dudit règlement, qui concluent des transactions qui ne sont ni des transactions intragroupe au sens de l’article 3 de ce règlement ni des transactions couvertes par les dispositions transitoires de l’article 89 dudit règlement avec les autres contreparties financières ou avec les autres contreparties non financières remplissant les conditions visées à l’article 10, paragraphe 1, point b) du règlement (UE) no 648/2012 portant sur des dérivés appartenant à une catégorie d’instruments dérivés qui a été déclarée soumise à l’obligation de négocier selon la procédure prévue à l’article 32 et inscrite au registre visé à l’article 34, le font uniquement sur:
1. Financial counterparties as defined in Article 2(8) of Regulation (EU) No 648/2012 and non-financial counterparties that meet the conditions referred to in Article 10(1)(b) thereof shall conclude transactions which are neither intragroup transactions as defined in Article 3 of that Regulation nor transactions covered by the transitional provisions in Article 89 of that Regulation with other such financial counterparties or other such non-financial counterparties that meet the conditions referred to in Article 10(1)(b) of Regulation (EU) No 648/2012 in derivatives pertaining to a class of derivatives that has been declared subject to the trading obligation in accordance with the procedure set out in Article 32 and listed in the register referred to in Article 34 only on:

– having regard to the draft for the new Protocol setting out the fishing opportunities and financial contribution provided for in the Fisheries Partnership Agreement between the European Community and the Republic of Mozambique (18058/2011),

10. Les transactions intragroupe visées à l'article 3, paragraphe 1, conclues par une contrepartie non financière et une contrepartie financière qui sont établies dans différents États membres donnent lieu à une exemption totale ou partielle de l'obligation prévue au paragraphe 3 du présent article, sur la base d'une décision positive de l'autorité compétente concernée chargée de la surveillance de la contrepartie financière, pour autant que les conditions suivantes soient remplies:
10. An intragroup transaction referred to in Article 3(1) that is entered into by a non-financial counterparty and a financial counterparty which are established in different Member States shall be exempt totally or partially from the requirement laid down in paragraph 3 of this Article, on the basis of a positive decision of the relevant competent authority responsible for supervision of the financial counterparty, provided that the following conditions are fulfilled:
