Il convient de constater qu’il ressort de l’arrêt attaqué que, par lettre du 15 octobre 2010, le directeur général faisant fonction de l’OLAF a indiqué à la requérante, en réponse à sa demande visant à la prolongation de son contrat d’agent temporaire, que ce dernier prendrait fin au 31 décembre 2010, compte tenu de l’absence de toute possibilité de prolongation au-delà de la période maximale de huit ans pour le personnel temporaire employé au sein de l’OLAF.
It is clear from the judgment under appeal that, by letter of 15 October 2010, the acting Director-General of OLAF informed the applicant, in response to her application for the extension of her temporary contract, that that contract would end on 31 December 2010, bearing in mind that there was no possibility of extension beyond the maximum period of eight years for temporary staff employed within OLAF.

Ainsi, il ne saurait être reproché à l’administration d’avoir conclu un contrat d’agent temporaire au titre de l’article 2, sous b), du régime applicable aux autres agents, puis de l’avoir résilié d’un commun accord et de l’avoir remplacé par un contrat au sens de l’article 2, sous a), dudit régime pour permettre à l’intéressé d’occuper un emploi compris dans le tableau des effectifs et auquel les autorités budgétaires ont conféré un caractère temporaire.
Thus, the administration cannot be criticised for having entered into a temporary staff contract on the basis of Article 2(b) of the Conditions of employment of other servants, having then terminated it by common agreement and replaced it by a contract within the meaning of Article 2(a) of those Conditions of employment in order to enable the staff member concerned to occupy a post included in the list of posts which the budgetary authorities have classified as temporary.

4. The relevant national law relating to labour contracts and other relevant instruments shall continue to apply to staff members with prior contracts who choose not to apply for temporary agent’s contracts or who are not offered temporary agents contracts in accordance with paragraph 2.

With the agreement of the High Representative and of the national diplomatic service concerned, the contracts of temporary staff from national diplomatic services of the Member States who were engaged, or whose contract was amended, after 30 November 2009 and who occupy a post in an organisational entity which is transferred from the General Secretariat of the Council or the Commission to the EEAS pursuant to Council Decision 2010/427/EU shall be transformed, without a new selection procedure, into contracts under Article 2(e) of the Conditions of Employment of Other Servants.

À la demande des personnes concernées, les contrats des agents temporaires des services diplomatiques nationaux des États membres qui ont été engagés après le 30 novembre 2009 et qui occupent un poste dans une entité organisationnelle qui est transférée du Secrétariat général du Conseil ou de la Commission au SEAE conformément à la décision du Conseil adoptée en vertu de l'article 27, paragraphe 3, du traité sur l'Union européenne sont transformés, sans nouvelle procédure de sélection, en contrats conformément à l'article 2, point e), du régime applicable aux autres agents.

At the request of the persons concerned, the contracts of temporary staff from national diplomatic services of the Member States who were engaged after 30 November 2009 and who occupy a post in an organisational entity which is transferred from the General Secretariat of the Council or the Commission to the EEAS pursuant to the Council Decision adopted in accordance with Article 27(3) of the Treaty on European Union shall be transformed, without a new selection procedure, into contracts under Article 2(e) of the Conditions of Employment of Other Servants.
