Calls therefore, on the Commission and Member States urgently to take steps, in line with Parliament’s position set out in its resolution of 8 July 2008 on the environmental impact of the planned gas pipeline in the Baltic Sea to link up Russia and Germany, to ensure that projects under the Action Plan properly assess and mitigate the negative environmental effects of the gas pipeline scheme; also considers that Nord Stream itself must be responsible for financing the measures needed to ensure that the Baltic Sea environment is not harmed as a result of the construction of the gas pipeline; calls, at the same time, for projects which are unnecessary because they can be carried out on land to be avoided in future;

Le gazoduc Nord Stream qui acheminera le gaz russe vers l’Europe est en cours de construction et, en Turquie, le gazoduc Blue Stream est prêt à l’emploi. Un accord sur la construction du gazoduc South Stream a été conclu entre les parties intéressées et l’Ukraine a lancé la construction du gazoduc White Stream. The Nord Stream pipeline transporting Russian gas to Europe is already under construction, and the Blue Stream in Turkey is ready; agreement has been reached by the interested parties on the building of South Stream, Ukraine has undertaken the creation of White Stream, and then there is the much talked-about Nabucco, albeit with uncertain sources or financial backing.

Your rapporteur supports the decision of 12 February 2008 by the Government of the Kingdom of Sweden refusing to grant the company Nord Stream permission to build the pipeline because of significant substantive and procedural shortcomings and, in particular, the failure to submit any study of alternative routes or the option of abandoning the construction of the pipeline.

Calls upon the states directly involved in the Nord Stream gas pipeline project to clarify before the final authorisation for the construction of the pipeline is given, where legal liability rests for the possible consequences of accidents on the ecology of the Baltic Sea and on the coastlines, inhabitants and economies of Baltic Sea states, including when vessels in the narrow navigation zones of the Gulf of Finland and of the Baltic proper cause damage to the pipeline on sinking.

In circumstances where an authorisation (for example, licence, permission, concession, consent or approval) is required for the construction or operation of natural gas facilities, the Member States or any competent authority they designate shall grant authorisations to build and/or operate such facilities, pipelines and associated equipment on their territory, in accordance with paragraphs 2 to 4.

4. For the development of newly supplied areas and efficient operation generally, and without prejudice to Article 38, Member States may decline to grant a further authorisation to build and operate distribution pipeline systems in any particular area once such pipeline systems have been or are proposed to be built in that area and if existing or proposed capacity is not saturated.
