D. considérant que, aux termes de l'article 57, paragraphe 2, de la loi constitutionnelle fédérale autrichienne, les membres du Conseil national ne peuvent être arrêtés pour une infraction pénale qu'avec l'autorisation du Conseil national - à moins qu'ils n'aient été pris en flagrant délit - et que l'autorisation du Conseil national est également requise pour effectuer des visites domiciliaires chez des membres du Conseil national; considérant que, en vertu de l'article 57, paragraphe 3, de la loi constitutionnelle fédérale autrichienne, une action officielle, en raison d'une infraction punissable, ne peut être intentée à l'encontre d'un membre du Conseil national sans l'autorisation du Conseil national, à moins que ladite infraction ne soit manifestement pas liée à l'activité politique du membre concerné; considérant qu'en vertu de cette disposition, l'autorité concernée doit obtenir une décision du Conseil national quant à l'existence, ou non, d'un tel lien lorsque le membre concerné ou un tiers des membres de la commission permanente compétente en fait la demande;
D. whereas, under Article 57(2) of the Austrian Federal Constitutional Law, members of the National Council (Nationalrat ) may only be arrested on the grounds of a criminal offence with the consent of the National Council – except where they are caught in the act of committing a crime – and whereas searches of the houses of members of the National Council likewise require the consent of the National Council; whereas, further to Article 57(3) of the Austrian Federal Constitutional Law, no official action on account of a punishable offence may be taken against members of the National Council without the National Council’s consent unless that offence is manifestly not connected with the political activity of the member in question and whereas, under that provision, the authority concerned must seek a decision from the National Council as to whether such a connection exists, where this is so requested by the member in question or one third of the members of the appropriate standing committee;

E. considérant que, conformément à l'article 57, paragraphe 2, de la loi constitutionnelle fédérale autrichienne, les membres du Conseil national (Nationalrat) ne peuvent être mis en état d'arrestation, s'ils sont suspectés de la commission d'une infraction pénale, qu'avec l'autorisation du Conseil national – excepté en cas de flagrant délit de commission d'une infraction –; et considérant que les visites domiciliaires chez des membres du Conseil national requièrent une autorisation du Conseil national; considérant que, en vertu de l'article 57, paragraphe 3, de la loi constitutionnelle fédérale autrichienne, une action officielle, en raison d'une infraction punissable, ne peut être intentée à l'encontre d'un membre du Conseil national sans l'autorisation du Conseil national, à moins que ladite infraction soit manifestement sans lien avec l'activité politique du membre concerné et considérant que, conformément à cette disposition, l'autorité concernée doit demander une décision au Conseil national quant à l'existence, ou non, d'un tel lien, si cela est demandé par le membre en question ou par le tiers des membres de la commission permanente compétente;
