C. considérant qu'au cours des vingt années qui se sont écoulées depuis la signature de l’accord de paix de Dayton, la constitution de Bosnie-Herzégovine a été "massivement dévastée" par des membres de la communauté internationale et un certain nombre d’acteurs locaux, y compris le Haut Représentant pour la Bosnie-Herzégovine, la Cour constitutionnelle de Bosnie-Herzégovine et le Conseil de sécurité des Nations unies;
C. whereas in the 20 years since the signing of the Dayton Peace Agreement the BiH Constitution has been ‘massively devastated’ by members of the international community and a number of local actors, including the High Representative for BiH, the BiH Constitutional Court and the UN Security Council;

D. considérant que l'article 3, paragraphe 3, point a), et l'article 3, paragraphe 5, de la constitution de Bosnie-Herzégovine sont utilisés par la Cour constitutionnelle de Bosnie-Herzégovine et le Bureau du Haut Représentant (BHR) pour légitimer des violations de l’accord de paix de Dayton par des motifs quasi juridiques;
D. whereas both Articles 3.5 and 3.3(a) of the BiH Constitution are being used by the BiH Constitutional Court and the Office of the High Representative (OHR) to legitimise unauthorised violations of the Dayton Peace Agreement on quasi-legal grounds;

4. est profondément convaincu que la constitution de Bosnie‑Herzégovine actuelle , telle qu'établie à l'annexe 4 de l'accord de paix de Dayton, doit être modifiée d'urgence afin de permettre à l'État de fonctionner d'une manière qui profite à l'ensemble de ses citoyens et d'entamer des négociations d'adhésion avec l'Union européenne; insiste sur le fait qu'il y a lieu d'entreprendre un processus de révision et de réforme constitutionnelles substantiel, indispensable pour permettre au cadre institutionnel du pays de fonctionner de manière effective et efficace;
4. Is deeply convinced that the current constitution of BiH, as laid down in Annex 4 to the Dayton Peace Agreement, is in urgent need of reform in order to allow the state to function in a way that benefits all its citizens and to permit accession talks with the EU; stresses the need for a substantial constitutional review and reform process that is necessary for the country’ institutional framework to work effectively and efficiently;

E. considérant qu'en 2009, la Cour européenne des droits de l'homme (CEDH) a conclu, dans l'affaire Sejdić et Finci, que certaines parties de la constitution de Bosnie‑Herzégovine actuelle étaient contraires à la convention européenne des droits de l'homme; qu'en 2014, la Cour a rendu un arrêt similaire dans l'affaire Zornic;
E. whereas in 2009 the European Court of Human Rights (ECtHR) ruled in the Sejdić and Finci case that parts of the current BiH constitution violate the European Convention on Human Rights; whereas in 2014 the court delivered a similar ruling in the Zornic case;

D. considérant que la Commission européenne pour la démocratie par le droit (la commission de Venise) a fait des propositions concrètes, modérées et détaillées concernant la manière de réformer la constitution de Bosnie-Herzégovine dans une perspective globale;
D. whereas the European Commission for Democracy Through Law (Venice Commission) has made detailed, moderate and practical proposals on how to reform BiH’s constitution in a holistic manner;
