La juridiction autrichienne a relevé de fortes similitudes entre le rôle joué par la Charte dans le système juridique de l’Union et celui joué par la convention européenne des droits de l’homme (CEDH) dans le cadre de la constitution autrichienne selon laquelle ladite convention a une valeur constitutionnelle.
It took the view that the Charter is enforceable in the proceedings brought before it for the judicial review of national legislation, and therefore individuals can rely upon the rights and the principles recognised in the Charter when challenging the lawfulness of domestic legislation. The Austrian Constitutional Court identified strong similarities between the role played by the Charter in the EU legal system and that played by the ECHR under the Austrian Constitution, according to which the ECHR has force of constitutional law.
