Definition: The essential feature is recurrent obsessional thoughts or compulsive acts. [25] Dans son arrêt n° 25446/06 du 24 avril 2012, Yordanova e.a./Bulgarie, la Cour européenne des droits de l'homme a considéré que, bien que les Roms concernés vivaient dans un camp illégal, leur éviction constituait une violation de l'article 8 de la Convention européenne des droits de l'homme (relatif au respect de la vie privée et de la propriété privée): en effet leur logement, bien que construit illégalement, devait être considéré comme leur propriété privée, et leur éviction constituait un acte disproportionné.

The Board shall compensate a national resolution authority for the damages to which it has been condemned by a national court, or which it has, in agreement with the Board, committed to pay in accordance with an amicable settlement, which are the consequences of an act or omission committed by that national resolution authority in the course of any resolution under this Regulation, unless that act or omission constituted a violation of Union law, this Regulation, a Decision of the Commission or a Decision of the Board, or constituted a manifest and serious error of judgement.
