Au plus tard le 3 juillet 2019, la Commission, après consultation de l’AEMF, présente au Parlement européen et au Conseil un rapport sur les incidences des articles 35 et 36 du présent règlement sur les contreparties centrales nouvellement établies et autorisées visées à l’article 35, paragraphe 5, et les plates-formes de négociation étroitement liées à ces contreparties centrales, en indiquant si les dispositions transitoires prévues à l’article 35, paragraphe 5, sont étendues, et en mettant en balance les avantages qui pourraient découler pour les consommateurs d’une amélioration de la concurrence et du choix offert aux participants au marché par rapport à l’effet disproportionné éventuel que ces dispositions pourraient avoir sur les contreparties centrales nouvellement établies et autorisées et aux contraintes qui pèseraient sur les participants au marché local pour l’accès aux contreparties centrales internationales et le bon fonctionnement du marché.
10. By 3 July 2019, the Commission shall, after consulting ESMA, submit a report to the European Parliament and to the Council on the impact of Article 35 and 36 of this Regulation on newly established and authorised CCPs as referred to in Article 35(5) and trading venues connected to those CCPs by close links and whether the transitional arrangement provided for in Article 35(5) shall be extended, weighing the possible benefits to consumers of improving competition and the degree of choice available to market participants against the possible disproportionate effect of those provisions on newly established and authorised CCPs and the constraints of local market participants in accessing global CCPs and the smooth functioning of the market.
