WHEREAS THE FIRST SUBPARAGRAPH OF ARTICLE 32 ( 1 ) OF REGULATION N 1009/67/EEC MAKES IT POSSIBLE FOR SUGAR MANUFACTURERS WHO DO NOT OPERATE THE " MIXED PRICE " SYSTEM PROVIDED FOR IN ARTICLE 31 OF THAT REGULATION TO CARRY FORWARD PART OF THEIR PRODUCTION UP TO A MAXIMUM CORRESPONDING TO 10 % OF THEIR BASIC QUOTAS ; WHEREAS THE TERM " BASIC QUOTA " MUST BE DEFINED SINCE THE PROVISIONS OF COUNCIL REGULATION N 1027/67/EEC ( 3 ) OF 21 DECEMBER 1967 ON THE FIXING OF BASIC QUOTAS FOR SUGAR ALLOW MEMBER STATES TO ALTER BASIC QUOTAS WITHIN CERTAIN LIMITS ;

considérant que l'article 32 paragraphe 1 du règlement nº 1009/67/CEE prévoit que le fabricant peut reporter une partie de sa production à la campagne sucrière suivante, au compte de la production de cette campagne ; que, par conséquent, le fabricant ne peut être obligé de conclure pour cette campagne sucrière des contrats de livraison au prix minimum de la betterave que pour la quantité de sucre comprise dans son quota de base qu'il n'a pas encore produite ; qu'il est, dès lors, approprié d'adapter l'obligation visée à l'article 30 paragraphe 2 dudit règlement en cas de report;
Whereas Article 32 (1) of Regulation No 1009/67/EEC provides that a manufacturer may carry forward part of his production to the following marketing year to be treated as part of that year's production ; whereas, consequently, for that marketing year delivery contracts at the minimum price for beet need only be concluded by the manufacturer in respect of the quantity of sugar within his basic quota which has not yet been produced ; whereas, therefore, the requirement referred to in Article 30 (2) of that Regulation should be adjusted in the event of sugar being carried forward;
