P. whereas the legislator and often insufficiently resourced tax administrations cannot anticipate, but only react, sometimes with great delay, to the innovative tax avoidance schemes which are designed and promoted by some tax advisers, in particular from very large accountancy firms, by lawyers and by intermediary companies; whereas, in particular, experience shows that EU bodies which should prevent the introduction of new harmful tax measures (such as the Code of Conduct Group set up by Member States in 1998 or the Commission, as guardian of the Treaties) have proved incapable of countering these undesirable developments, sometimes reacting in an ineffective way or on the basis of too a limited mandate, and that many new and often aggressive tax avoidance measures or agreements, such as patent boxes, have been introduced in the EU; whereas MNCs are relying, in the EU and worldwide, on the expertise of a well-organised and skilled sector of tax advisers, as well as banks and other financial service providers, for the development of their tax avoidance schemes; whereas this sector is at the same time represented in bodies advising governments and public institutions on tax matters, such as, for instance, the EU Platform for Tax Good Governance; whereas there are concerns over the conflicts of interest that might arise from the provision by the same firms of advice to both public authorities and private MNCs;

Calls on the Commission and the Member States to take such measures as are necessary to encourage, promote and support business start-ups and self-employment of young women by providing them with training, counselling and easier access to credit and microcredit offering favourable terms and fiscal facilities, in particularly for SMEs;

Its other equally tasking responsibilities include: providing analysis, advice, and recommendations on tax and trade policy and preparing tax and trade legislation; providing analysis, advice, and recommendations about the management of the federal financial assets and liabilities, including the management of federal and crown corporations borrowing on financial markets; managing transfers and fiscal relations with the provinces and territories; developing financing and investment policy for the Canada Pension Plan in conjunction with the provinces; representing Canada with international financial institutions and international economic and trade fora; and developing policies for and advising on the financial sector and financial markets.

S'il faut bien entendu saluer ces mesures plus strictes, elles ne peuvent porter atteinte à l'obligation de secret professionnel d'un certain nombre de groupes professionnels, notamment des avocats, des notaires ou des conseillers fiscaux.
Whilst we of course welcome more stringent measures, they should not lead to a watering down of the obligation of professional secrecy for various professions, and above all for lawyers, notaries and tax consultants.

For example, the Canadian Public Accountability Board has been set up to monitor the independence and the role of auditors when they examine financial statements (1630) This body, which is actually chaired by the former governor of the Bank of Canada, will establish the rules by which audit firms can engage in non-audit work, such as tax work or management consulting, for audit clients of listed companies.

Il : - invite les Etats membres à accélérer la pleine application des directives concernant le marché intérieur, notamment dans les domaines des marchés publics, des services d'investissement et des assurances ; - demande au Conseil d'accélérer les travaux pour l'adoption du statut de la société européenne et du cadre juridique pour les inventions biotechnologiques et souligne l'importance des accords récemment intervenus au sein du Conseil concernant le marché intérieur de l'électricité et les télécommunications et invite le Conseil à aller plus loin sur la voie d'une plus grande libéralisation de ces secteurs ; - invite la Commission à soumettre au Conseil, avant la fin de l'année, les premiers résultats de son initiative concernant des mesures concrètes de simplification (SLIM) ; - demande au Conseil d'adopter le nouveau Plan d'action pour les petites et moyennes entreprises (PME) avant fin 1996 pour renforcer leur potentiel de développement afin qu'elles puissent bénéficier pleinement du marché intérieur et contribuer ainsi plus efficacement à la création d'emplois ; - invite la Commission à élaborer un plan d'action sur les mesures à prendre en matière d'innovation ; - demande au Conseil de lui soumettre, avant le Conseil européen de Dublin, un rapport sur l'évolution des systèmes fiscaux à l'intérieur de l'Union, en tenant compte de la nécessité de créer un environnement fiscal stimulant l'entreprise et la création d'emplois et de promouvoir une politique de l'environnement plus efficace.
It: - calls on Member States to speed up the full implementation of the Directives concerning the internal market, in particular in the public procurement, investment services and insurance fields; - asks the Council to expedite proceedings for the adoption of the Statute for a European company and the legal framework for biotechnological inventions and stresses the importance of the recent agreements within the Council on the internal electricity market and telecommunications and calls upon the Council to go further in the direction of the greater liberalisation in those sectors; - calls on the Commission to submit the Council before the end of the year the initial results of its initiative on practical simplification measures (SLIM); - requests the Council to adopt the new action plan for small and medium- sized enterprises (SME) before the end of 1996 to reinforce the potential for their further development so that they can benefit fully from the internal market and thus make a more effective contribution to the creation of jobs; - calls on the Commission to draw up an action plan concerning the measures to be taken with regard to innovation; - requests the Council to submit to it, before the European Council in Dublin, a report on the development of tax systems within the Union, taking account of the need to create a tax environment that stimulates enterprise and the creation of jobs and promote a more efficient environmental policy.

S'agissant de la politique de coopération au développement, le Conseil considère qu'elle doit notamment s'appuyer : - sur le développement des capacités et le renforcement des institutions, en s'appuyant sur l'assistance technique, la recherche et la formation technique ou professionnelle, et en favorisant l'appropriation des mesures d'intégration régionale (par le renforcement des capacités locales, la sensibilisation du secteur privé et de la société civile et la création de réseaux d'informations sur l'intégration régionale) ; - sur le soutien au secteur privé pour qu'il saisisse les opportunités de l'intégration (contacts entre les chefs d'entreprises, soutien à la création d'entreprises conjointes, centres d'information et de conseil, formation) ; il doit s'accompagner d'un appui technique spécifique au renforcement du secteur financier (système bancaire et assurances) ; - au niveau national, sur les instruments mis en oeuvre dans le cadre de l'ajustement structurel, afin d'aider les Etats sous ajustement mettant en oeuvre des réformes visant à la libéralisation économique intra-régionale qui impliquent des coûts transitionnels nets ; une assistance technique dans le domaine des réformes économiques, y compris en ce qui concerne les adaptations des systèmes fiscaux, pourra également être envisagée.
Against this background, the Community and its Member States hope that policy on trade and on development cooperation will be capable of promoting regional economic integration among developing countries. 8. The Council considers that development cooperation policy must be based, inter alia, on: - developing capabilities and strengthening institutions, using technical assistance, research and technical or vocational training, and helping to make regional integration measures better fitted to their goals (by strengthening local capability, increasing awareness in the private sector and civil society and setting up information networks on regional integration); - support for the private sector, to help it take advantage of the opportunities offered by integration (contacts between heads of undertakings, support for setting up joint ventures, information and advisory centres and training); it must go hand in hand with specific technical support for strengthening the financial sector (banking and insurance); - at national level, on structural adjustment instruments, to help states in the process of adjustment which are carrying out reforms aimed at intra-regional economic liberalization involving net transitional costs; technical assistance in the area of economic reform, including adjustments to taxation systems, may also be contemplated.

Pour certaines délégations, il est très important que la taxe ne s'applique qu'au-dessus d'un certain niveau d'émissions par rapport à la moyenne de la Communauté ; PREND ACTE des progrès réalisés au sein du groupe de travail ad hoc sur la proposition de la Commission visant à introduire une taxe CO2/énergie et de ce qu'une décision relative à un instrument fiscal de ce type sera nécessaire notamment pour définir la base de calcul de la taxe ; S'ENGAGE à adopter rapidement les propositions concernant la directive SAVE et le programme ALTENER de la Communauté et INVITE le Parlement européen à transmettre son avis sur ces propositions avant la session du Conseil (Energie) de juin 1993 ; SOULIGNE l'importance des efforts déployés en commun par les pays industrialisés et des mesures efficaces qu'ils ont prises pour lutter contre le changement climatique et, dès lors, DECIDE que la Communauté prendra également rapidement une initiative dans le cadre de l'OCDE afin de promouvoir l'utilisation des instruments fiscaux en vue de mener une action efficace et coordonnée de réduction des émissions de CO2 compatible avec sa propre stratégie et qu'en même temps elle poursuivra un dialogue constructif avec ses autres partenaires commerciaux, les producteurs d'énergie et les pays en développement ; SE FELICITE à cet égard de la proposition du gouvernement américain visant à instaurer de nouvelles taxes sur l'énergie, qui constitue une contribution importante qui, conjuguée à l'instauration de taxes par d'autres pays de l'OCDE dans ce domaine, contribue à répondre à la demande de la Communauté de réduire les effets sur la compétitivité de toute taxe d'effet équivalent introduite par la Communauté ; INVITE la présidence à jeter les bases d'une décision sur la création d'un instrument fiscal en vue d'accélérer les travaux du Conseil (ECOFIN).
To some delegations it is decisive that the tax will only apply above a certain level of emissions related to the EC average; NOTES the progress made in the Ad Hoc Working Party on the Commission's proposal for a carbon/energy tax, and that a decision on a fiscal instrument of this nature will need inter alia to define the base for the calculation of the tax; PLEDGES its commitment to the rapid adoption of the proposals for the SAVE directive and ALTENER programme of the Community, and URGES the European Parliament to forward its opinion on these proposals before the meeting of the Council (Energy) in June 1993; STRESSES the importance of joint efforts and effective measures on the part of industrialized countries to combat climate change and therefore AGREES that the Community will also rapidly take an initiative in the OECD framework in order to promote the use of fiscal instruments with a view to an effective and coordinated effort to reduce CO2 emissions, consistent with the Community's own strategy; that at the same time it will continue a constructive dialogue with its other trading partners, energy producers and developing countries; WELCOMES in this context the US administration's proposal for new energy taxes as an important contribution which, together with the tax initiatives of the other OECD countries in this field, helps to meet the Community's demand that the effects on competitiveness of any corresponding tax initiative by the Community be reduced; URGES the Presidency to establish a basis for a decision on a fiscal instrument with a view to accelerating the work in the Council (ECOFIN).
