L'article 3, paragraphe 1, de l'Acte d'adhésion prévoit que les dispositions de l'acquis de Schengen et les actes fondés sur celles-ci ou qui s'y rapportent, énumérés à l'annexe I de l'Acte, sont contraignants et s'appliquent aux nouveaux États membres à compter de la date d'adhésion[27]. Les dispositions et actes qui ne sont pas mentionnés dans cette annexe, bien qu'ils soient contraignants pour les nouveaux États membres à compter de la date d'adhésion, ne s'appliquent dans un nouvel État membre qu'à la suite d'une décision du Conseil prise à cet effet, conformément à cet article (article 3, paragraphe 2, de l'Acte d'adhésion).
Article 3(1) of the Act of Accession states that the provisions of the Schengen acquis and the acts building upon it or otherwise related to it, listed in Annex I to the Act, will be binding on and applicable in the new Member States from the date of accession.[27] Provisions and acts not referred to in the Annex, while binding on the new Member States from the date of accession, will only apply in a new Member State pursuant to a Council decision to that effect taken in accordance with the article (Article 3(2) of the Act of Accession).
