TRADUCTIONS EN CONTEXTE

modifier la loi sur la Cour suprême, afin de ne pas réduire l'âge de départ à la retraite des juges actuellement en fonction, de supprimer le pouvoir discrétionnaire dont dispose le président quant à la prolongation du mandat des juges de la Cour suprême et de supprimer la procédure de recours extraordinaire, qui prévoit la possibilité de remettre en cause des jugements définitifs rendus plusieurs années auparavant; modifier la loi sur le Conseil national de la magistrature, de manière à ne pas mettre fin au mandat des juges membres et à veiller à ce que le nouveau système de nomination continue de garantir l'élection des juges membres par leurs pairs; modifier ou abroger la loi sur l'organisation des juridictions de droit commun, notamment pour supprimer le nouveau régime de retraite applicable aux juges, y compris le pouvoir discrétionnaire dont dispose le ministre de la justice pour ce qui est de prolonger le mandat des juges et de nommer et de révoquer les présidents des tribunaux; restaurer l'indépendance et la légitimité du Tribunal constitutionnel, en veillant à ce que ses juges, son président et son vice-président soient élus légalement et à ce que tous ses jugements soient publiés et pleinement mis en œuvre; s'abstenir d'actes et de déclarations publiques susceptibles de saper davantage encore la légitimité du pouvoir judiciaire.
Amend the Supreme Court law, not apply a lowered retirement age to current judges, remove the discretionary power of the President to prolong the mandate of Supreme Court judges, and remove the extraordinary appeal procedure, which includes a power to reopen final judgments taken years earlier; Amend the law on the National Council for the Judiciary, to not terminate the mandate of judges-members, and ensure that the new appointment regime continues to guarantee the election of judges-members by their peers; Amend or withdraw the law on Ordinary Courts Organisation, in particular to remove the new retirement regime for judges including the discretionary powers of the Minister of Justice to prolong the mandate of judges and to appoint and dismiss presidents of courts; Restore the independence and legitimacy of the Constitutional Tribunal, by ensuring that its judges, President and Vice-President are lawfully elected and by ensuring that all its judgements are published and fully implemented; Refrain from actions and public statements which could further undermine the legitimacy of the judiciary.

E. considérant que, aux termes de l'article 57, paragraphe 2, de la loi constitutionnelle fédérale autrichienne, les membres du Conseil national (Nationalrat ) ne peuvent être arrêtés pour une infraction pénale qu'avec l'autorisation du Conseil national – à moins qu'ils n'aient été pris en flagrant délit – et considérant que l'autorisation du Conseil national est également requise pour effectuer des visites domiciliaires chez des membres du Conseil national; considérant que, en vertu de l'article 57, paragraphe 3, de la loi constitutionnelle fédérale autrichienne, une action officielle, en raison d'une infraction punissable, ne peut être intentée à l'encontre d'un membre du Conseil national sans l'autorisation du Conseil national, à moins que ladite infraction ne soit manifestement pas liée à l'activité politique du membre concerné et considérant que, en vertu de cette disposition, l'autorité concernée doit obtenir une décision du Conseil national quant à l'existence, ou non, d'un tel lien, lorsque le membre concerné ou un tiers des membres de la commission permanente compétente en fait la demande;
E. whereas, under Article 57(2) of the Austrian Federal Constitutional Law, Members of the National Council (Nationalrat ) may only be arrested on the grounds of a criminal offence with the consent of the National Council – except where they are caught in the act of committing a crime – and whereas searches of the houses of members of the National Council likewise require the consent of the National Council; whereas, further to Article 57(3) of the Austrian Federal Constitutional Law, no official action on account of a punishable offence may be taken against members of the National Council without the National Council’s consent unless that offence is manifestly not connected with the political activity of the member in question and whereas, under that provision, the authority concerned must seek a decision from the National Council as to whether such a connection exists, where this is so requested by the member in question or one third of the members of the appropriate standing committee;

E. considérant que, conformément à l'article 57, paragraphe 2, de la loi constitutionnelle fédérale autrichienne, les membres du Conseil national (Nationalrat) ne peuvent être mis en état d'arrestation, s'ils sont suspectés de la commission d'une infraction pénale, qu'avec l'autorisation du Conseil national – excepté en cas de flagrant délit de commission d'une infraction –; et considérant que les visites domiciliaires chez des membres du Conseil national requièrent une autorisation du Conseil national; considérant que, en vertu de l'article 57, paragraphe 3, de la loi constitutionnelle fédérale autrichienne, une action officielle, en raison d'une infraction punissable, ne peut être intentée à l'encontre d'un membre du Conseil national sans l'autorisation du Conseil national, à moins que ladite infraction soit manifestement sans lien avec l'activité politique du membre concerné et considérant que, conformément à cette disposition, l'autorité concernée doit demander une décision au Conseil national quant à l'existence, ou non, d'un tel lien, si cela est demandé par le membre en question ou par le tiers des membres de la commission permanente compétente;

L'autorité compétente doit toutefois demander une décision au Conseil national quant à l'existence, ou à l'absence, d'un tel lien si le membre en question ou un tiers des membres appartenant à la commission permanente compétente en fait la demande.
The authority concerned must however seek a decision by the National Council on the existence of such a connection if the member in question or a third of the members belonging to the Standing Committee entrusted with these matters so demands.

Les États membres veillent à ce que soient mises en place, conformément au droit de l’Union et au droit national applicables ainsi qu’à la directive 2013/11/UE du Parlement européen et du Conseil , des procédures indépendantes, impartiales, transparentes et efficaces de règlement extrajudiciaire aux fins du règlement des litiges opposant les utilisateurs de services de paiement aux prestataires de services de paiement quant aux droits et obligations qui découlent des titres III et IV de la présente directive en recourant, le cas échéant, aux organismes compétents existants.
1. Member States shall ensure that adequate, independent, impartial, transparent and effective ADR procedures for the settlement of disputes between payment service users and payment service providers concerning the rights and obligations arising under Titles III and IV of this Directive are established according to the relevant national and Union law in accordance with Directive 2013/11/EU of the European Parliament and the Council , using existing competent bodies where appropriate.

28. se félicite du fonctionnement des conseils nationaux des minorités démocratiquement élus, chargés de représenter les minorités nationales dans les domaines de l'éducation, de la culture, des médias et de l'utilisation des langues officielles; fait observer qu'il importe de mettre en œuvre intégralement les compétences de ces administrations autonomes des minorités et de fournir les subventions budgétaires garanties par la loi sur les conseils nationaux des minorités; prend acte avec inquiétude des plaintes quant aux irrégularités dans le processus de préparation et aux conditions légales nécessaires à la mise en place des conseils, ainsi que des plaintes relatives à la violation par certains ministères et certaines municipalités des compétences garanties des conseils nationaux, et invite les autorités à y répondre; se félicite des décisions du Tribunal administratif serbe qui ont soutenu les procès intentés par le Conseil national de la minorité nationale hongroise, à la suite de la violation par les autorités locales des compétences du Conseil national;
28. Welcomes the functioning of the democratically elected national minority councils, which represent national minorities in the fields of education, culture, media and official language use; notes, however, the importance of the full implementation of the competencies of these minority self-governing bodies and the necessity of adequate budgetary subsidies guaranteed by the Law on National Minority Councils; notes with concern the complaints about the irregularities in the preparation process and the legal requirements for the establishment of the councils, as well as the complaints about the violation of the guaranteed competencies of national councils by some ministries and local municipalities, and calls on the authorities to respond to them; welcomes those decisions of the Serbian Administrative Court which have upheld the cases brought by the National Council of the Hungarian National Minority arising from the violation of the competencies of the National Council by local authorities;

Member States shall ensure that in cases where, under the national law for the particular UCITS, the merger proposal must be approved by unit-holders, the information may contain a recommendation by the respective management company or board of directors of the investment company as to the course of action.

Les correspondants nationaux du Réseau judiciaire européen se réunissent sur une base ad hoc, au moins une fois par an et en fonction des besoins des membres, à l’invitation du correspondant national de l’État membre qui exerce la présidence du Conseil, lequel prend également en considération les souhaits des États membres quant aux réunions des correspondants.

The European Judicial Network national correspondents shall meet on an ad hoc basis, at least once a year and as its members deem appropriate, at the invitation of the national correspondent of the Member State which holds the Presidency of the Council, which shall also take account of the Member States wishes for the correspondents to meet.
