Regulation (EU) No 912/2010 should be aligned with the principles contained in the common approach of the European Parliament, the Council and of the Commission to the decentralised agencies, adopted by the three institutions on 5 July, 26 June and 12 June 2012 respectively, particularly with regard to the rules for adopting decisions of the Administrative Board, the terms of office of the members of the Administrative Board and of the Security Accreditation Board and those of their chairpersons, the existence of a multiannual work programme, the powers of the Administrative Board concerning staff management, assessment and revision of that Regulation, prevention and management of conflicts of interest and handling of non-classified but sensitive information.

3. Les modalités pratiques d’application des paragraphes 1 et 2 en ce qui concerne notamment la présentation, la hiérarchisation et le suivi des demandes adressées à l’Agence ainsi que l’information du conseil d’administration et du conseil exécutif au sujet de ces demandes sont prévues par le conseil d’administration dans les règles internes de fonctionnement de l’Agence.

(13) Administrative cooperation and mutual assistance between the Member States should comply with the rules on the protection of personal data laid down in Directive 95/46/EC, and with regard to administrative cooperation through the Internal Market Information System (IMI), it should also comply with Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the EU institutions and bodies and on the free movement of such data and Regulation (EU) xxx (IMI Regulation) on administrative cooperation through the Internal Market Information System (IMI).

Notes with concern that as in its previous reports, the Court of Auditors has noted the need to introduce a system of remuneration for services provided by Member States authorities, based on their real costs; regrets that no progress has been made on this issue since 2009, when a proposal for a new payment system was presented to the Management Board but no agreement was reached; notes that the Agency will present a new proposal for a new payment system to the Management Board in March 2013; acknowledges the efforts made by the Agency's executives to encourage a decision by the Management Board to revise the system of remuneration of Member States services based on real costs; is fully aware of the fact that the little progress made is due to the lack of decision taken by the Management Board; welcomes, therefore, the approach by the Agency's administration to call upon the Commission for further assistance in this matter; urges the Agency to inform the discharge authority about the developments on this issue, inter alia on the state of play as regards the new action plan and the Management Board's position on it;

7. juge inacceptable que, alors que le conseil d'administration de l'Autorité ne compte que 15 membres, chaque réunion coûte en moyenne 92 630 euros, soit 6 175 euros par membre; souligne que ce montant est près de trois fois plus élevé que celui du deuxième conseil d'administration le plus coûteux d'une agence décentralisée; estime que les coûts des réunions du conseil d'administration sont excessifs et qu'ils doivent être réduits de manière drastique; invite l'Autorité et son conseil d'administration à remédier à la situation sans délai et à informer l'autorité de décharge des mesures prises pour le 30 juin 2012;
7. Finds it unacceptable that while the Management Board of the Authority consists of only 15 members, each meeting costs on average EUR 92 630, which represents an amount of EUR 6 175 per member; underlines that this amount is nearly three times higher than the second most expensive Management Board of a decentralised agency; is of the opinion that the Management Board meetings costs are excessive and should be reduced drastically; calls on the Authority and its Management Board to remedy the situation immediately and to inform the discharge authority of the measures undertaken by 30 June 2012;

11. considère comme importante une infrastructure performante au niveau des moyens informatiques afin de garantir un flux constant d'informations sur les risques, y compris jusqu'au niveau du conseil d'administration; estime que la décision concernant les mesures techniques à prendre pour améliorer la qualité et la rapidité de la transmission de l'information au conseil d'administration doit être laissée aux établissements financiers, et donc au conseil d'administration lui-même, de façon à permettre une adaptation optimale de ces mesures aux besoins éventuels, au niveau de chaque société;

Takes the view that a high-performance IT infrastructure guaranteeing the rapid flow of information on risk right up to board-of-directors level is important; considers that the decision on implementing technical measures to improve the quality and speed of transmission of information to the board of directors should be left to the financial institutions, and thus to the board of directors thereof, so as to allow arrangements to be made that are tailored to each institution and to its specific requirements;
