La Commission d’aménagement et la Commission d’examen peuvent, soit individuellement, soit ensemble conjointement avec l’Office des eaux du Nunavut et le Conseil de gestion des ressources fauniques du Nunavut — et formant alors le Conseil du milieu marin du Nunavut mentionné à l’article 15.4.1 de l’accord —, conseiller les ministères et organismes en ce qui concerne les zones marines et formuler des recommandations à cet égard. Les gouvernements du Canada et du Nunavut tiennent compte de ces conseils et recommandations pour la prise de toute décision touchant ces zones.
196. The Commission and the Board may advise departments or agencies and make recommendations to them respecting marine areas, either individually or, as part of the Nunavut Marine Council referred to in section 15.4.1 of the Agreement, both acting jointly with the Nunavut Water Board and the Nunavut Wildlife Management Board, and the Government of Canada and the Government of Nunavut must consider that advice and those recommendations when making any decision that may affect those marine areas.

41. 41. The Board may, either jointly with the Nunavut Planning Commission, the Nunavut Impact Review Board and the Nunavut Wildlife Management Board, as established by the Agreement, acting as the Nunavut Marine Council referred to in section 15.4.1 of the Agreement, or on its own, advise and make recommendations respecting any marine area to any department or agency of the Government of Canada or the Government of Nunavut, and those governments shall consider that advice and those recommendations when making any decision that may affect that marine area.

The committee recommends that the Nunavut Marine Council (Part 4, Article 15.4.1 of the 2003 Nunavut Land Claims Agreement) be created as a forum for priority setting and planning, and as a practical means to enhance Canada’s sovereignty in marine areas (See pages 36 and 44).
