Taking account of the principle of separation and the establishment of the Supervisory Board and the Administrative Board of Review, two distinct procedures should apply: (a) where the ECB contemplates the imposition of administrative penalties in the exercise of its supervisory tasks, decisions to this effect are taken by the Governing Council of the ECB based on a complete draft decision from the Supervisory Board and subject to review by the Administrative Board of Review; and (b) where the ECB contemplates the imposition of sanctions in the exercise of its non-supervisory tasks, decisions to this effect are taken by the Executive Board of the ECB and subject to review by the Governing Council of the ECB.

Le conseil des gouverneurs de la BCE devrait inviter les représentants des États membres participants dont la monnaie n’est pas l’euro lorsqu’il envisage d’émettre une objection à l’égard d’un projet de décision élaboré par le conseil de surveillance ou lorsque les autorités compétentes nationales concernées informent le conseil des gouverneurs de leur désaccord motivé avec ce projet de décision du conseil de surveillance, si cette décision est adressée aux autorités nationales au sujet d’établissements de crédit établis dans des États membres participants dont la monnaie n’est pas l’euro.
The Governing Council of the ECB should invite the representatives from participating Member States whose currency is not the euro whenever it is contemplated by the Governing Council to object to a draft decision prepared by the Supervisory Board or whenever the concerned national competent authorities inform the Governing Council of their reasoned disagreement with a draft decision of the Supervisory Board, when such decision is addressed to the national authorities in respect of credit institutions from participating Member States whose currency is not the euro.

7. Si un État membre participant dont la monnaie n’est pas l’euro notifie à la BCE, conformément à l’article 26, paragraphe 8, son désaccord motivé avec une objection du conseil des gouverneurs à un projet de décision du conseil de surveillance, le conseil des gouverneurs rend son avis, dans un délai de 30 jours, sur le désaccord motivé exprimé par l’État membre et confirme ou retire son objection en indiquant ses motifs.
7. If a participating Member State whose currency is not the euro notifies the ECB in accordance with Article 26(8) of its reasoned disagreement with an objection of the Governing Council to a draft decision of the Supervisory Board, the Governing Council shall, within a period of 30 days, give its opinion on the reasoned disagreement expressed by the Member State and, stating its reasons to do so, confirm or withdraw its objection.
