On a reasoned proposal by one third of the Member States, by the European Parliament or by the Commission, the Council, acting by a majority of four fifths of its members after obtaining the assent of the European Parliament, may determine that there is a clear risk of a serious breach by a Member State of principles mentioned in Article 6(1), and address appropriate recommendations to that State.

2. Le Conseil, réuni au niveau des chefs d'État ou de gouvernement et statuant à l'unanimité sur proposition d'un tiers des États membres ou de la Commission et après avis conforme du Parlement européen, peut constater l'existence d'une violation grave et persistante par un État membre de principes énoncés à l'article 6, paragraphe 1, après avoir invité le gouvernement de cet État membre à présenter toute observation en la matière.

Calls on the Commission to keep it fully informed, before and during the Ministerial Conference in Qatar and throughout the negotiations, and to discuss with it regularly, on the basis of the resolutions adopted by Parliament, the essential elements of the EU's negotiating strategy; reserves the right, in the course of the new round, to give the Commission recommendations, pursuant to Rule 97(5) of its Rules of Procedure, on the individual items being negotiated, and calls on the Commission to take due account of such recommendations as a precondition to parliamentary assent to the final result of the negotiations; insists on being consulted, pursuant to the assent procedure set out in Article 300 of the EC Treaty, on the conclusion of the results of the new round; requests that in the meantime the post-Nice process should include a significant strengthening of accountability with regard to the common commercial policy by finally introducing codecision;

So, with the agreement of Olivier Duhamel, the rapporteur, I suggest incorporating this principle in the last line of Paragraph 20, which would therefore read as follows: “from the moment the process is initiated up to the approval (after receiving the assent of the European Parliament) of the final version of the Constitution”.
