TRADUCTIONS EN CONTEXTE

57. déplore que la question du Sahara occidental ne figure pas à l'ordre du jour des sessions 2016 du CDH; souligne de nouveau que le conflit au Sahara occidental est une question de décolonisation et que, selon le droit international, le Royaume du Maroc n'a aucune souveraineté sur le Sahara occidental et est considéré comme la puissance occupante; condamne les violations constantes des droits fondamentaux du peuple sahraoui; appelle à la protection des droits fondamentaux du peuple du Sahara occidental, y compris la liberté d'association, la liberté d'expression et le droit de manifester; exige la libération immédiate de tous les prisonniers politiques sahraouis et, de manière urgente, des membres du groupe de Gdeim Izik condamnés par le tribunal militaire marocain; réitère son appel à l'Espagne pour qu'elle accepte l'asile politique pour le jeune sahraoui Hassana Aalia, condamné à perpétuité à l'issue de son procès; souligne la nécessité d'une surveillance internationale de la situation des droits de l'homme au Sahara occidental; demande au Maroc et au Front Polisario de poursuivre les négociations en vue d'une solution pacifique et durable au conflit au Sahara occidental et réaffirme le droit à l'autodétermination du peuple sahraoui, qui doit faire l'objet d'un référendum démocratique, conformément aux résolutions 34/37 et 35/19 des Nations unies;
57. Criticises the fact that the issue of Western Sahara has not been placed on the agenda for the 2016 sessions of the HRC; emphasises once again that the Western Sahara conflict is a decolonisation issue and that, under international law, the Kingdom of Morocco has no sovereignty over Western Sahara and is regarded as the occupying power; condemns the persistent violation of the fundamental rights of the Sahrawi people; calls for the protection of the fundamental rights of the people of Western Sahara, including freedom of association, freedom of expression and the right to demonstrate; calls for the immediate release of all Sahrawi political prisoners and, as a matter of urgency, of the members of the Gdeim Izik group condemned by the Moroccan military tribunal; repeats its call to Spain to grant political asylum to the young Sahrawi Hassana Aalia, sentenced by a court to life imprisonment; stresses the need for international monitoring of the human rights situation in Western Sahara; calls on Morocco and the Polisario Front to continue the negotiations which are designed to lead to a peaceful and lasting solution to the Western Sahara conflict, and reaffirms the right of the Sahrawi people to self-determination, which must be decided by a democratic referendum held in accordance with United Nations Resolutions 34/37 and 35/19;

Welcomes and echoes the April 2013 report of the UN Secretary-General on the situation concerning Western Sahara, which stresses ‘the critical importance of addressing the Western Sahara conflict as part of a broader strategy for the Sahel’, and the fact that ’the issue of human rights remains important for any resolution of the conflict’; notes that the ongoing conflicts in the Sahel, in particular the presence of terrorist groups, such as AQIM in northern Mali and southern Algeria, are factors which risk destabilising Western Sahara, as well as the wider region; notes, furthermore, the negative impact of the conflict on regional integration, which should involve Morocco and Algeria, and which could offer significant opportunities for democratisation and economic development, enhancing human security throughout the Sahel and Sahara;

Calls on the Commission and Member States – considering that the political solution to the Western Sahara conflict, reconciliation and the human rights situation are closely linked – to be more active in the resolution of the Western Sahara conflict, not only supporting the UN negotiations but also using its various external policy instruments (for example strengthening human rights monitoring and awareness among police and security forces, supporting democratic reforms, including decentralisation, fighting discrimination in the region) to promote much needed confidence building between the conflict parties;

There are two clear examples towards the west and the south, namely the conflict in the Sahara, to which Mrs Ferrero-Waldner has referred, and the conflict with Israel or, to put it another way, the responsibility of Morocco and the State of Israel for two conflicts: the occupied territories of the Western Sahara and the Palestinian conflict.
