(3) Sous réserve des paragraphes (1) et (2), lorsqu’une personne est employée dans une mission diplomatique ou un poste consulaire d’une Partie sur le territoire de l’autre Partie, ou au service privé d’un représentant d’une telle mission ou d’un tel poste, elle est assujettie à la législation de cette dernière Partie qui régit l’obligation de verser des cotisations comme si elle était employée sur son territoire, à moins que dans les trois mois suivant l’entrée en vigueur de la présente Convention, ou le début de l’emploi, selon la dernière de ces éventualités, elle choisisse d’être assurée en vertu de la législation de la première Partie, à la condition qu’elle était ainsi assurée à un moment quelconque avant le début de l’emploi dans cette mission ou ce poste.
(3) Subject to paragraphs (1) and (2), where a person is employed in a diplomatic mission or consular post of one Party in the territory of the other Party, or in the private service of an official of such a mission or post, the legislation of the latter Party concerning liability for contributions shall apply to him or her as if he or she were employed in its territory, unless within three months of the entry into force of this Convention, or within three months of the beginning of the employment in the territory of the latter Party, whichever is later, he or she chooses to be insured under the legislation of the former Party, provided that he or she had been so insured at any time before the commencement of the employment at that mission or post.

(e) all benefits provided under the provision in respect of periods before 1991 are acceptable to the Minister and, for the purposes of this condition, any benefits in respect of periods before 1991 that become provided after 1988 with respect to a member who is connected with an employer who participates in the plan or was so connected at any time before the benefits become provided shall, unless the Minister is notified in writing that the benefits are provided with respect to the member, be deemed to be unacceptable to the Minister;

5. At the request of the competent institution or in the cases referred to in paragraph 3, the institution of the place of residence shall have the medical condition of the insured person checked, where necessary, as if that person were insured by it.

6. L'institution du lieu de résidence procède ultérieurement, en tant que de besoin, au contrôle administratif ou médical de la personne assurée comme si elle était assurée auprès d'elle.

An insured person who is authorised by the competent institution to go to another Member State with the purpose of receiving the treatment appropriate to his condition shall receive the benefits in kind provided, on behalf of the competent institution, by the institution of the place of stay, in accordance with the provisions of the legislation it applies, as though he were insured under the said legislation.

An insured person who is authorised by the competent institution to go to the territory of another Member State to receive there the treatment appropriate to his condition shall receive the benefits in kind provided, on behalf of the competent institution, by the institution of the place of stay, in accordance with the provisions of the legislation administered by that institution, as though he were insured pursuant to the said legislation.

Les mesures visées par cette décision et les conditions dont elle était assortie doivent être réexaminées en même temps que les mesures fiscales et financières qui ont été prises ultérieurement, car cela pourrait signifier qu'Olympic Airways a bénéficié d'un traitement préférentiel par rapport à ses concurrents.
The measures and conditions covered by that decision have to be examined again, together with new subsequent fiscal and financial measures, resulting in a potential preferential treatment of OA in respect to competitors.

C'est cette decision qui a fait l'objet du recours de l'association italienne d'entreprises siderurgiques I. S.A. dont les adherents produisent surtout les categories IV et VI. En donnant raison a cette association, alors que la Commission avait soutenu qu'elle avait le choix des procedures, la Cour a constate que la Commission etait tenue de recourir a la procedure plus souple de l'article 58 par. 3 pour mettre fin au regime de quotas, notamment pour les categories IV et VI des le 1er janvier 1987, des lors qu'elle etait d'avis qu'il n'y avait plus de crise manifeste. En conclusion, si la Commission s'est fait critiquer par la Cour pour avoir choisi une procedure "lourde", impliquant l'avis conforme du Conseil, alors qu'elle avait a sa disposition une procedure 'souple', cet arret signifie en meme temps que la Cour insiste sur les pouvoirs propres de la Commission des lors que ceux-ci s'inscrivent "dans le cadre du retablissement progressif de conditions normales de concurrence".
This decision was appealed against by the I. S.A (Italian Steelmakers Association) whose members mainly produce products in Categories IV and VI. In ruling in favour of this association, rather than the Commission which had maintained that it had the right to choose whose procedure to follow, the Court found that since the Commission considered that there was no longer a manifest crisis, it should have applied the more flexible procedure of Article 58(3) to end the quota system for Categories IV and VI on 1 January 1987 (*) See information memo P 78 of 15 June 1988 Consequently, although the Commisison came in for criticism from the Court for choosing a more difficult procedure (involving the assent of the Council) when it had at its disposal a more flexible procedure, the Court's judgment nevertheless emphasizes that the Commission has independent powers in connection with the gradual restoration of normal conditions of competition.
