The Court was asked if a Member State could make the surrender of a person convicted in absentia conditional upon the conviction being open to review in the issuing Member State, in order to avoid any adverse effects on the right to a fair trial and the rights of the defence as guaranteed by the constitution of the Member State surrendering the person in question[41].

4. Il revient à l’autorité compétente de l’État d’émission d’informer la personne condamnée, dans une langue qu’elle comprend, qu’elle a décidé de transmettre le jugement et le certificat en utilisant le modèle type de notification qui figure à l’annexe II. Si la personne condamnée se trouve dans l’État d’exécution au moment où cette décision est prise, le formulaire en question est transmis à l’État d’exécution, qui informe en conséquence la personne condamnée.
4. The competent authority of the issuing State shall inform the sentenced person, in a language which he or she understands, that it has decided to forward the judgment together with the certificate by using the standard form of the notification set out in Annex II. When the sentenced person is in the executing State at the time of that decision, that form shall be transmitted to the executing State which shall inform the sentenced person accordingly.

La transmission de l'exécution d'une condamnation à une peine privative de liberté peut être demandée lorsque : a) la personne condamnée se trouve sur le territoire de l'État d'exécution et est ressortissante de ce dernier État ou réside habituellement sur son territoire, ou b) la personne condamnée se trouve sur le territoire de l'État d'exécution et son extradition a été refusée, ou serait refusée en cas de demande, ou n'est pas possible, ou c) la personne condamnée se trouve sur le territoire de l'État d'exécution où elle subit ou doit subir une peine privative de liberté (art. 3).
The transfer of enforcement of a sentence involving deprivation of liberty may be requested where (a) the sentenced person is in the territory of the administering State and is a national of that State or is permanently resident in its territory; or (b) the sentenced person is in the territory of the administering State and his extradition has been refused, would be refused if requested, or is not possible; or (c) the sentenced person is in the territory of the administering State and is serving or is to serve a custodial sentence there (Article 3).

Le Protocole complète la Convention sur le transfèrement des personnes condamnées de 1983 et définit les règles applicables au transfert de l'exécution des peines, d'une part des personnes condamnées s'étant évadées de l'État de condamnation pour regagner l'État dont elles sont ressortissantes, d'autre part des personnes condamnées faisant l'objet d'une mesure d'expulsion ou de reconduite à la frontière en raison de leur condamnation.
The Protocol amplifies the 1983 Convention on the transfer of sentenced persons and lays down rules applicable to the transfer of enforcement of sentences as regards sentenced persons who have fled from the sentencing State to return to the State of which they are nationals and sentenced persons who are subject to an expulsion or deportation order on account of their conviction.
