I. whereas freedom of the press is still under great pressure in Egypt and journalists are still being detained on the basis of unfounded allegations; whereas a number of journalists were prosecuted in 2014 on charges related to threatening national unity and social peace, spreading false news reports and collaborating with the Muslim Brotherhood; whereas the Court of Cassation, Egypt’s highest court of law, ruled that there were procedural failings in the trial of journalists Mohammed Fahmy, Peter Greste and Baher Mohamed from Al‑Jazeera; whereas, however, the three journalists are set for retrial and charges of ‘falsifying news’ and ‘involvement with the Muslim Brotherhood’ against them have not been dropped; whereas three other journalists – Sue Turton, Dominic Kane and Rena Netjes – were sentenced in absentia to 10 years in prison; whereas Egyptian journalists Mahmoud Abdel Nabi, Mahmoud Abu Zeid, Samhi Mustafa, Ahmed Gamal, Ahmed Fouad and Abdel Rahman Shaheen were convicted for merely carrying out their legitimate activities; whereas there is extreme polarisation of the Egyptian media into pro- and anti‑Morsi factions, which is reinforcing the polarisation of Egyptian society;

A private prosecution has been brought against Mr Hans-Peter Martin in the Vienna Regional Criminal Court on 6 June 2007 by Merkur Treuhand Wirtschaftstreuhand- und Steuerberatungs Gesellschaft mit beschränkter Haftung for commercial defamation pursuant to Section 152 of the Austrian Criminal Code on the ground that, both on his website www.hpmartin.net and in APA-OTS press release OTS0189 5 11 0473 NEF0006 in connection with the accusations against him (by the EU anti-fraud authority OLAF) of improper use of the secretarial assistance allowance for staff, he had claimed that it had been established after a comprehensive, detailed investigation that he had in no way improperly used EU monies and that fault had been found only with a formal error on the part of his accounts manager at the time, Mr Christoph Matznetter, a tax adviser now State Secretary for Finance in the Austrian Government, who, according to Mr Martin, had incorrectly charged three staff computers and two telephone bills to the secretarial assistance allowance instead of to the office expenses allowance.

1. Each Member State shall ensure that in the course of criminal proceedings against a person, previous convictions handed down against the same person for different facts in other Member States, in respect of which information has been obtained under applicable instruments on mutual legal assistance or on the exchange of information extracted from criminal records, are taken into account to the extent previous national convictions are taken into account, and that equivalent legal effects are attached to them as to previous national convictions, in accordance with national law.

Un transfèrement ne peut avoir lieu aux termes de la Convention qu'aux conditions suivantes (art. 3): a) le condamné doit être ressortissant de l'État d'exécution; b) le jugement doit être définitif; c) la durée de condamnation que le condamné a encore à subir doit être au moins de six mois à la date de réception de la demande de transfèrement, ou indéterminée; d) le condamné ou, lorsqu'en raison de son âge ou de son état physique ou mental l'un des deux Etats l'estime nécessaire, son représentant doit consentir au transfèrement; e) les actes ou omissions qui ont donné lieu à la condamnation doivent constituer une infraction pénale au regard du droit de l'État d'exécution ou devraient en constituer une s'ils survenaient sur son territoire; et f) l'État de condamnation et l'État d'exécution doivent s'être mis d'accord sur ce transfèrement.
A transfer may be made under the Convention only on the following conditions (Article 3): a) if that person is a national of the administering State; b) if the judgment is final; c) if, at the time of receipt of the request for transfer, the sentenced person still has at least six months of the sentence to serve or if the sentence is indeterminate; d) if the transfer is consented to by the sentenced person or, where in view of his age or his physical or mental condition one of the two States considers it necessary, by the sentenced person's legal representative; e) if the acts or omissions on account of which the sentence has been imposed constitute a criminal offence according to the law of the administering State or would constitute a criminal offence if committed on its territory; and f) if the sentencing and administering States agree to the transfer.

En outre, la décision prononcée dans l'État requérant doit être définitive et exécutoire et l'infraction en raison de laquelle la sanction a été prononcée doit constituer également une infraction selon la législation de l'État requis (exigence de « double incrimination » [76]).
According to the Convention, the sentencing State may request another Contracting State to enforce a sentence only if one or more of the conditions set out in Article 5 are fulfilled, namely: (a) if the sentenced person is ordinarily resident in the other State; (b) if the enforcement of the sentence in the other State is likely to improve the prospects for the social rehabilitation of the sentenced person; (c) if, in the case of a sentence involving deprivation of liberty, the sentence could be enforced following the enforcement of another sentence involving deprivation of liberty which the sentenced person is undergoing or is to undergo in the other State; (d) if the other State is the State of origin of the sentenced person and has declared itself willing to accept responsibility for the enforcement of that sentence; or (e) if it considers that it cannot itself enforce the sentence, even by having recourse to extradition, and that the other State can. In addition, the judgment handed down in the requesting State must be final and enforceable and the offence in respect of which the sentence has been passed must also constitute an offence under the law of the requested State ("double criminality" requirement [76]).
