7. Takes the view that a failure to review Yulia Tymoshenko's conviction will jeopardise the conclusion of the Association Agreement and its ratification, while pushing the country further away from the realisation of its European perspective; expresses concern at some signs of decline in democratic freedoms and at the possible instrumentalisation of state institutions for partisan purposes and to exact political revenge;

E. considérant que la sentence du 11 octobre 2011, condamnant Ioulia Timochenko, ancien Premier ministre de l'Ukraine, à sept ans d'emprisonnement, et les procès intentés à d'autres membres de l'ancien gouvernement sont inacceptables et constituent un acte de justice sélective; que de graves manquements sont constatés en ce qui concerne l'indépendance du pouvoir judiciaire et le manque de réforme à tous les stades de la procédure judiciaire: poursuite, procès, condamnation, détention et appels;
E. whereas the sentencing on 11 October 2011 of Ukraine's former Prime Minister Yulia Tymoshenko to seven years in prison, and the trials of other high officials of the former government are not acceptable and constitute an act of selective justice; whereas serious deficiencies are noted with regard to the independence of the judiciary and the lack of reform in all aspects of the judicial process: prosecution, trial, sentencing, detention and appeals;
