Welcomes the conclusion of the negotiations on the Schengen Governance Package; calls on the Commission to play its role fully as coordinator of the Schengen evaluations and as guardian of the Treaties, in order to avoid any situation that could endanger the functioning of the Schengen area; recalls that the Schengen area depends on mutual trust and that each Member State fulfils its obligations, including the control of external borders, in accordance with the provisions of the Schengen Borders Code, comprising also the use of available technologies; highlights the importance of tackling trafficking and smuggling at borders, including the trafficking of migrants; reiterates its position that the Schengen area should, without further delay, be enlarged to include Romania and Bulgaria;

In order to ensure the adequate involvement of the European Parliament and of the Council in the second phase of application of the reciprocity mechanism, given the particularly sensitive political nature of the suspension of the exemption from the visa requirement for all the nationals of a third country listed in Annex II to Regulation (EC) No 539/2001 and its horizontal implications for the Member States, the Schengen associated countries and the Union itself, in particular for their external relations and for the overall functioning of the Schengen area, the power to adopt acts in accordance with Article 290 of the Treaty of the Functioning of the European Union should be delegated to the Commission in respect of certain elements of the reciprocity mechanism.

Afin d'éviter que l'élargissement de l'espace Schengen ne rende les déplacements à l'intérieur de cet espace plus difficiles pour certaines catégories de personnes, il convient de maintenir l'assouplissement prévu dans la décision no 895/2006/CE (4) qui autorise les ressortissants de pays tiers titulaires d'un visa national de court séjour délivré par l'un des États membres concernés à traverser le territoire d'autres États membres concernés. Par conséquent, certaines dispositions de ladite décision devraient continuer à s'appliquer pendant une période transitoire limitée.
In order to avoid the enlargement of the Schengen area causing travel within the area to become more difficult for certain categories of persons, the facilitation provided by Decision No 895/2006/EC (4) for third-country nationals holding a national short-term visa issued by one of the Member States concerned for transit through the territory of other Member States concerned, should be maintained. Consequently, certain provisions of that Decision should continue to apply for a limited, transitional period.

A full exemption from the visa requirement exists already for these three categories of persons residing within the Schengen area when they enter or re-enter that area; a general exemption should be introduced for persons of those categories residing in a Member State which has not or not yet joined the Schengen area, as far as their entry or re-entry into the territory of any other Member State bound by the Schengen acquis is concerned.
