La Commission salue l'accord politique conclu aujourd'hui entre les États membres en ce qui concerne l'échange automatique d'informations financières de nature fiscale sur les entreprises multinationales, connues sous le nom de «déclaration pays par pays», sous réserve de l'examen favorable du Parlement britannique.
The Commission welcomes today's political agreement by Member States on the automatic exchange of tax-related financial information of multinational companies, known as country-by-country reporting, subject to UK parliamentary scrutiny.

104. déplore le contenu de l'accord politique du 6 octobre 2015 au sein du Conseil, qui n'est pas à la hauteur de la proposition législative de la Commission présentée en mars 2015 modifiant la directive 2011/16/UE en ce qui concerne l'échange automatique et obligatoire d'informations dans le domaine fiscal; souligne que celle-ci prévoyait, en plus d'un cadre commun en matière d'enregistrement et d'échange automatique d'informations sur les rescrits, des dispositions permettant à la Commission d'en contrôler efficacement la mise en application par les États membres tout en veillant à ce que les rescrits ne portent pas préjudice au marché intérieur; souligne que l'adoption de la position du Conseil empêcherait de tirer pleinement parti de l'échange automatique d'informations sur les rescrits fiscaux, en particulier en termes de mise en œuvre effective, et invite donc le Conseil à s'en tenir à la proposition de la Commission et à tenir dûment compte de l'avis du Parlement sur le sujet, en particulier en ce qui concerne le champ d'application de la directive (tous les rescrits fiscaux et pas seulement les rescrits transfrontaliers), la période de rétroactivité (tous les rescrits fiscaux encore valides seraient échangés) et les informations à fournir à la Commission, qui devrait avoir accès aux rescrits fiscaux;

Deplores the content of the political agreement of 6 October 2015 within the Council, which falls short of the Commission’s legislative proposal of March 2015 amending Directive 2011/16/EU as regards mandatory automatic exchange of information in the field of taxation; stresses that the latter provided, on top of a common framework for the registration and automatic exchange of information on rulings, provisions allowing the Commission to effectively monitor its implementation by Member States and ensure that rulings do not have a negative impact on the internal market; stresses that the adoption of the Council’s position would prevent drawing all benefits from the automatic exchange of rulings, in particular in terms of effective implementation, and calls on the Council, therefore, to stick to the Commission’s proposal and take due account of the Parliament’s opinion thereon, in particular as regards the scope of the directive (all tax rulings instead of cross-border only), the retroactivity period (all tax rulings still valid should be exchanged) and the information provided to the Commission, which should have access to the tax rulings;

(5) The possibility that the provision of information may be refused where it would lead to the disclosure of a commercial, industrial or professional secret or of a commercial process, or of information whose disclosure would be contrary to public policy should not apply to provisions of mandatory automatic exchange of information on advance cross-border rulings and advance pricing arrangements in order not to reduce the effectiveness of these exchanges.

(5) Afin que l'efficacité de ces échanges ne soit pas amoindrie, la possibilité que la transmission d'informations puisse être refusée dans le cas où elle conduirait à divulguer un secret commercial, industriel ou professionnel ou un procédé commercial, ou une information dont la divulgation serait contraire à l'ordre public ne doit pas s'appliquer aux dispositions concernant l'échange automatique et obligatoire d'informations sur les décisions fiscales anticipées et les accords préalables en matière de prix de transfert.

Le Conseil estime que des assurances suffisantes ont été obtenues en ce qui concerne l'application des mêmes mesures suivant les mêmes procédures que les douze États membres ou que la Belgique, le Luxembourg et l'Autriche dans l'ensemble des territoires dépendants ou associés concernés (îles anglo-normandes, île de Man et territoires dépendants ou associés des Caraïbes) et demande aux États membres concernés de faire en sorte que tous les territoires dépendants ou associés appliquent ces mesures à partir de la date de mise en œuvre de la directive; il est entendu que si la Belgique, le Luxembourg et l'Autriche décident de procéder à l'échange automatique d'informations, tout territoire prélevant une retenue à la source procédera lui aussi, à compter de la même date que ces États membres, à l'échange automatique d'informations.
The Council assesses that sufficient reassurances have been obtained with regard to the application of the same measures applying the same procedures as the 12 Member States or as Austria, Belgium and Luxembourg, in all relevant dependent or associated territories (the Channel Islands, Isle of Man, and the dependent or associated territories in the Caribbean) and asks the Member States concerned to ensure that all relevant dependent or associated territories will apply those measures from the date of implementation of the Directive, it being understood that, if and when Austria, Belgium and Luxembourg will implement automatic exchange of information, any territory applying the withholding tax will also implement automatic exchange of information from the same date as those Member States.
