Lorsque le Conseil décide d’accorder au Parlement européen l’accès à des informations classifiées qu’il détient dans le domaine de la politique étrangère et de sécurité commune, il prend des décisions ad hoc à cet effet ou a recours à l’accord interinstitutionnel du 20 novembre 2002 entre le Parlement européen et le Conseil concernant l’accès du Parlement européen à des informations sensibles du Conseil dans le domaine de la politique de sécurité et de défense (1) (ci-après dénommé «accord interinstitutionnel du 20 novembre 2002»), selon le cas.
Where the Council decides to grant the European Parliament access to classified information held by the Council in the area of the common foreign and security policy, it either takes ad hoc decisions to that effect or uses the Interinstitutional Agreement of 20 November 2002 between the European Parliament and the Council concerning access by the European Parliament to sensitive information of the Council in the field of security and defence policy (1) (hereinafter ‘the Interinstitutional Agreement of 20 November 2002’), as appropriate.

En particulier, l’article 218, paragraphe 6, du traité sur le fonctionnement de l’Union européenne dispose que, sauf lorsqu’un accord international porte exclusivement sur la politique étrangère et de sécurité commune, le Conseil adopte la décision de conclusion de l’accord concerné après avoir obtenu l’approbation du Parlement européen ou l’avoir consulté. Tous les accords internationaux qui ne portent pas exclusivement sur la politique étrangère et de sécurité commune relèvent donc du présent accord interinstitutionnel.
In particular, Article 218(6) TFEU provides that, except where an international agreement relates exclusively to the common foreign and security policy, the Council is to adopt the decision concluding the agreement in question after obtaining the consent of or consulting the European Parliament; all such international agreements which do not relate exclusively to the common foreign and security policy are therefore covered by this Interinstitutional Agreement.

Vu l'accord-cadre sur les relations entre le Parlement européen et la Commission européenne (1), signé le 20 octobre 2010 (ci-après dénommé «accord-cadre»), et l'accord interinstitutionnel entre le Parlement européen et le Conseil relatif à la transmission au Parlement européen et au traitement par celui-ci des informations classifiées détenues par le Conseil concernant d'autres questions que celles relevant de la politique étrangère et de sécurité commune (2), signé le 12 mars 2014, («l'accord interinstitutionnel»), il est nécessaire de définir des règles spécifiques sur le traitement des informations confidentielles par le Parlement européen.
In the light of the Framework Agreement on relations between the European Parliament and the European Commission (1) signed on 20 October 2010 (‘the Framework Agreement’) and the Interinstitutional Agreement between the European Parliament and the Council concerning the forwarding to and handling by the European Parliament of classified information held by the Council on matters other than those in the area of the Common Foreign and Security Policy (2) signed on 12 March 2014 (‘the Interinstitutional Agreement’), it is necessary to lay down specific rules on the treatment of confidential information by the European Parliament.

En outre, ces deux documents, qui sont désormais complétés par l’accord interinstitutionnel - auquel le Conseil participe également au nom d’une meilleure réglementation -, sont issus de débats et de négociations qui n’ont pas été faciles mais où nous avions tous le plus vif intérêt à ce que les choses se déroulent bien et fonctionnent correctement pour construire une Europe plus efficace.

The Centre's work should be conducted in a transparent fashion and its management should be subject to all existing good governance and anti-fraud rules, in particular Regulation (EC) No 1073/1999 of the European Parliament and of the Council of 25 May 1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) (9) and the Interinstitutional Agreement of 25 May 1999 between the European Parliament, the Council of the European Union and the Commission of the European Communities concerning internal investigations by the European Anti-fraud Office (OLAF) (10) to which the Centre has acceded and the necessary implementing provisions of which it has adopted.

Je pense que l’accord interinstitutionnel auquel nous sommes parvenus est un bon accord et je tiens à féliciter ma collègue, Mme Frassoni, pour le travail de la commission des affaires constitutionnelles, mais aussi pour le travail qu’elle a réalisé. Je tiens aussi à féliciter pour leur travail le président Gargani ainsi que plusieurs membres de ce groupe de travail interinstitutionnel - MM. Swoboda et Clegg.
I believe that the interinstitutional agreement reached is a good agreement and I would like to congratulate my colleague, Mrs Frassoni, on the work of the Committee on Constitutional Affairs, on the work she herself has done and also the good work done by President Gargani and many members of that interinstitutional working group – Mr Swoboda and Mr Clegg – and we in the Committee on Legal Affairs are happy with the result.
