Definition: Symptoms are presented by the patient as if they were due to a physical disorder of a system or organ that is largely or completely under autonomic innervation and control, i.e. the cardiovascular, gastrointestinal, respiratory and urogenital systems. The symptoms are usually of two types, neither of which indicates a physical disorder of the organ or system concerned. First, there are complaints based upon objective signs of autonomic arousal, such as palpitations, sweating, flushing, tremor, and expression of fear and distress about the possibility of a physical disorder. Dans les cas où le médiateur a constaté un cas de mauvaise administration, il saisit l'institution, organe ou organisme concerné, qui dispose d'un délai de trois mois pour lui faire tenir son avis. Le médiateur transmet ensuite un rapport au Parlement européen et à l'institution, organe ou organisme concerné.
Where the Ombudsman establishes an instance of maladministration, he shall refer the matter to the institution, body, office or agency concerned, which shall have a period of three months in which to inform him of its views. The Ombudsman shall then forward a report to the European Parliament and the institution, body, office or agency concerned.

Je désire notamment remercier le médiateur européen, avec lequel nous avons vécu, au sein de la commission des pétitions, l'expérience enrichissante d'une rencontre entre cultures juridiques différentes - en réalisant des avancées importantes en matière de mise au point de procédures à même de réaliser et concrétiser le droit de pétition - et d'une réflexion sur l'accord interinstitutionnel et, surtout, en ce qui concerne le médiateur, en développant le réseau et, partant, la prise de conscience par les régions d'Europe de la nécessité de la relation avec les citoyens par l'intermédiaire des médiateurs régionaux.
I would like, in particular, to thank the European Ombudsman, together with whom we have witnessed within the Committee on Petitions a fruitful experimental encounter between different legal traditions, with progress made towards the achievement of major goals in terms of the development of procedures to implement the right of petition and make it a reality, with reflection on the Interinstitutional Agreement and, most importantly, as far as the Ombudsman is concerned, with the development of the network, with the realisation on the part of the regions of Europe of the essential nature of the relationship with the citizens which is established through the regional ombudsmen.

M. Duff vient d’intervenir à l’instant sur le rapport de Mme Almeida Garrett concernant le médiateur européen, et je dois dire que j’ai été convaincue par son argumentation quand il disait que les membres des institutions devraient, le cas échéant, pouvoir être entendus par le médiateur lorsqu’il est question de mauvaise administration.
Mr Duff has already referred to Teresa Almeida Garrett’s report on the Statute of the European Ombudsman, and I have to say his arguments convince me that it should be possible that members of the institutions can also if necessary be heard by the Ombudsman when it is a matter of administrative error.
