TRADUCTIONS EN CONTEXTE

35. exprime sa sympathie et sa solidarité à l'égard de la population de Hong Kong par son soutien en faveur des réformes démocratiques; souligne que l'autonomie de Hong Kong est garantie par la loi fondamentale; fait valoir que l'introduction d'un suffrage universel à part entière dans la région administrative spéciale est totalement compatible avec le principe "un pays, deux systèmes"; regrette que la réforme de la loi électorale relative à la nomination du chef de l'exécutif de Hong Kong n'ait pu être menée à bien; espère qu'un nouveau processus de réforme pourra prochainement être amorcé dans l'optique d'accorder aux citoyens de Hong Kong le droit au suffrage universel direct en 2017, assorti d'un véritable choix entre divers candidats; accueille favorablement le rapport conjoint du Service européen pour l'action extérieure et de la Commission au Parlement européen et au Conseil du 24 avril 2015 intitulé "Région administrative spéciale de Hong Kong: rapport annuel 2014", et soutient l'engagement de l'Union européenne en faveur du renforcement de la démocratie, dont l'état de droit, l'indépendance du système judiciaire, les libertés et les droits fondamentaux, la transparence et la liberté d'information et d'expression à Hong Kong;
35. Expresses its sympathy and solidarity with the people of Hong Kong in support of democratic reforms; highlights that Hong Kong’s autonomy is guaranteed by the Basic Law; holds that the introduction of fully-fledged universal suffrage in the Special Administrative Region is fully compatible with the ‘One country, two systems’ principle; deplores the fact that the reform of the electoral law for the appointment of the Chief Executive in Hong Kong could not be completed; expresses its hope that a new reform process can be started in the near future with the aim of giving the people of Hong Kong the right to direct universal suffrage in 2017, with a genuine choice amongst diverse candidates; welcomes the Joint Report of 24 April 2015 of the European External Action Service and the European Commission to the European Parliament and the Council: ‘Hong Kong Special Administrative Region: Annual Report 2014’, and supports the EU’s commitment to strengthening democracy, including the rule of law, independence of the judicial system, fundamental freedoms and rights, transparency and freedom of information and expression in Hong Kong;

a) dans le cas de la Région administrative spéciale de Hong Kong : sous réserve des dispositions de la législation de la Région administrative spéciale de Hong Kong relative à l’attribution d’un crédit sur l’impôt de la Région administrative spéciale de Hong Kong de l’impôt payé dans un territoire en dehors de la Région administrative spéciale de Hong Kong (qui sont sans effet sur le principe général du présent article), l’impôt canadien payé en vertu de la législation du Canada et conformément au présent accord, directement ou par voie de retenue, au titre des revenus qu’une personne qui est un résident de la Région administrative spéciale de Hong Kong tire de sources situées au Canada ouvre droit à un crédit sur l’impôt de la Région administrative spéciale de Hong Kong exigible au titre de ces revenus, sous réserve que ce crédit n’excède pas le montant de l’impôt de la Région administrative spéciale de Hong Kong calculé relativement à ces revenus conformément à la législation fiscale de la Région administrative spéciale de Hong Kong;
(a) In the case of the Hong Kong Special Administrative Region, subject to the provisions of the laws of the Hong Kong Special Administrative Region relating to the allowance of a credit against Hong Kong Special Administrative Region tax of tax paid in a jurisdiction outside the Hong Kong Special Administrative Region (which shall not affect the general principle of this Article), Canadian tax paid under the laws of Canada and in accordance with this Agreement, whether directly or by deduction, in respect of income derived by a person who is a resident of the Hong Kong Special Administrative Region from sources in Canada, shall be allowed as a credit against Hong Kong Special Administrative Region tax payable in respect of that income, provided that the credit so allowed does not exceed the amount of Hong Kong Special Administrative Region tax computed in respect of that income in accordance with the tax laws of the Hong Kong Special Administrative Region.

d) si cette personne a le droit de séjour dans la Région administrative spéciale de Hong Kong et possède la nationalité du Canada ou si elle n’a pas le droit de séjour dans la Région administrative spéciale de Hong Kong ni ne possède la nationalité du Canada, les autorités compétentes des parties tranchent la question d’un commun accord.
(d) if the individual has the right of abode in the Hong Kong Special Administrative Region and is also a national of Canada, or if the individual does not have the right of abode in the Hong Kong Special Administrative Region and is not a national of Canada, the competent authorities of the Parties shall settle the question by mutual agreement.
