The point of this recital is to explain the wording of Article 11 ‘Adaptations’. However, from a legal point of view, it is impermissible that a comitology procedure, exclusively provided for in order to regulate the Commission’s executive powers, be used to adopt provisions to apply such amendments as may in future be introduced into the international instruments, because in some cases, these amendments could modify the scope of the relevant existing Community legislation and in such cases only the competent legislative institutions can make the requisite amendments, by means of the appropriate legal procedure.
