Il y a donc lieu de modifier la directive 98/78/CE du Parlement européen et du Conseil du 27 octobre 1998 sur la surveillance complémentaire des entreprises d’assurance et de réassurance faisant partie d’un groupe d’assurance ou de réassurance pour y introduire une définition des compagnies financières holding mixtes et élargir son champ d’application à ce type d’entreprise.
For this reason, Directive 98/78/EC of the European Parliament and of the Council of 27 October 1998 on the supplementary supervision of insurance and reinsurance undertakings in an insurance or reinsurance group should be amended to define and include mixed financial holding companies.

La législation existante de l’Union régissant le domaine couvert par le présent règlement comprend aussi la directive 2002/87/CE du Parlement européen et du Conseil du 16 décembre 2002 relative à la surveillance complémentaire des établissements de crédit, des entreprises d’assurance et des entreprises d’investissement appartenant à un conglomérat financier , la directive 98/78/CE du Parlement européen et du Conseil du 27 octobre 1998 sur la surveillance complémentaire des entreprises d’assurance faisant partie d’un groupe d’assurance , le règlement (CE) no 1781/2006 du Parlement européen et du Conseil du 15 novembre 2006 relatif aux informations concernant le donneur d’ordre accompagnant les virements de fonds , la directive 2009/110/CE du Parlement européen et du Conseil du 16 septembre 2009 concernant l’accès à l’activité des établissements de monnaie électronique et son exercice ainsi que la surveillance prudentielle de ces établissements et les parties pertinentes de la directive 2005/60/CE du Parlement européen et du Conseil du 26 octobre 2005 relative à la prévention de l’utilisation du système financier aux fins du blanchiment de capitaux et du financement du terrorisme , de la directive 2002/65/CE du Parlement européen et du Conseil du 23 septembre 2002 concernant la commercialisation à distance de services financiers auprès des consommateurs et de la directive 2007/64/CE du Parlement européen et du Conseil du 13 novembre 2007 concernant les services de paiement dans le marché intérieur
Existing Union legislation regulating the field covered by this Regulation also includes Directive 2002/87/EC of the European Parliament and of the Council of 16 December 2002 on the supplementary supervision of credit institutions, insurance undertakings and investment firms in a financial conglomerate , Directive 98/78/EC of the European Parliament and of the Council of 27 October 1998 on the supplementary supervision of insurance undertakings in an insurance group , Regulation (EC) No 1781/2006 of the European Parliament and of the Council of 15 November 2006 on information on the payer accompanying transfers of funds , Directive 2009/110/EC of the European Parliament and of the Council of 16 September 2009 on the taking up, pursuit and prudential supervision of the business of electronic money institutions , and the relevant parts of Directive 2005/60/EC of the European Parliament and of the Council of 26 October 2005 on the prevention of the use of the financial system for the purpose of money laundering and terrorist financing , of Directive 2002/65/EC of the European Parliament and of the Council of 23 September 2002 concerning the distance marketing of consumer financial services and of Directive 2007/64/EC of the European Parliament and of the Council of 13 November 2007 on payment services in the internal market

(11) La présente directive devrait s'appliquer aux entreprises de réassurance ayant la réassurance pour activité exclusive et n'effectuant pas d'opérations d'assurance directe. Elle devrait aussi concerner les entreprises dites "captives de réassurance", qui sont créées ou possédées par une entreprise financière autre qu'une entreprise d'assurance ou de réassurance ou un groupe d'entreprises d'assurance ou de réassurance relevant de la directive 98/78/CE du Parlement européen et du Conseil du 27 octobre 1998 sur la surveillance complémentaire des entreprises d'assurance faisant partie d'un groupe d'assurance , ou par une ou plusieurs entreprises non financières et qui ont pour objet la fourniture de produits de réassurance couvrant exclusivement les risques des entreprises auxquelles elles appartiennent.
(11) This Directive should apply to reinsurance undertakings which conduct exclusively reinsurance business and do not engage in direct insurance business; it should also apply to the so-called "captive" reinsurance undertakings created or owned by either a financial undertaking other than an insurance or reinsurance undertaking or a group of insurance or reinsurance undertakings to which Directive 98/78/EC of the European Parliament and of the Council of 27 October 1998 on the supplementary supervision of insurance undertakings in an insurance group applies, or by one or several non-financial undertakings, the purpose of which is to provide reinsurance cover exclusively to the risks of the undertakings to which they belong.

(11) La présente directive devrait s’appliquer aux entreprises de réassurance ayant la réassurance pour activité exclusive et n’effectuant pas d’opérations d’assurance directe. Aux fins de la présente disposition, les règles sectorielles pertinentes prévoyant sous quelle forme et dans quelle mesure sont couverts les établissements financiers (lorsque les sociétés de gestion de portefeuille relèvent du champ d'application de la surveillance consolidée des établissements de crédit et des entreprises d'investissement) et les entreprises de réassurance (lorsque les sociétés de gestion de portefeuille relèvent du champ d'application de la surveillance complémentaire des entreprises d'assurance), s'appliquent mutatis mutandis aux sociétés de gestion de portefeuille.
For the purposes of this provision, the relevant sectoral rules regarding the form and extent of the inclusion of financial institutions (where asset management companies are included in the scope of consolidated supervision of credit institutions and investment firms) and of reinsurance undertakings (where asset management companies are included in the scope of supplementary supervision of insurance undertakings) shall apply mutatis mutandis to asset management companies.

(a) that the competent authorities of the Member States are able to obtain the information necessary for the supplementary supervision of insurance undertakings which have their head office in the Community and which have subsidiaries or hold participations in undertakings outside the Community; and
