TRADUCTIONS EN CONTEXTE

Aux fins de la bonne application du présent règlement, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne, en ce qui concerne les exigences de marquage des animaux de compagnie des espèces répertoriées à l’annexe I, partie B, qui sont spécifiques à certaines espèces et les mesures sanitaires qui, en fonction des espèces, doivent être prises pour prévenir des maladies ou infections autres que la rage auxquelles sont sensibles les espèces répertoriées à l’annexe I, ainsi que l’adoption de règles visant à limiter le nombre d’animaux de compagnie des espèces répertoriées à l’annexe I, partie B, accompagnant leur propriétaire lors de mouvements non commerciaux, et la modification des annexes II à IV. Il importe particulièrement que la Commission procède aux consultations appropriées durant son travail préparatoire, y compris au niveau des experts. Il convient que, lorsqu’elle prépare et élabore des actes délégués, la Commission veille à ce que les documents pertinents soient transmis simultanément, en temps utile et de façon appropriée, au Parlement européen et au Conseil.
In order to ensure the proper application of this Regulation, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of species-specific requirements for the marking of pet animals of the species listed in Part B of Annex I and species-specific preventive health measures against diseases or infections other than rabies affecting the species listed in Annex I, as well as to adopt rules for limiting the number of pet animals of the species listed in Part B of Annex I accompanying their owner during non-commercial movement and to amend Annexes II to IV. It is of particular importance that the Commission carry out appropriate consultations during its preparatory work, including at expert level. The Commission, when preparing and drawing up delegated acts, should ensure simultaneous, timely and appropriate transmission of relevant documents to the European Parliament and Council.

Afin d’assurer une publication simultanée du présent règlement et des actes d’exécution en ce qui concerne les listes de territoires et de pays tiers établies aux fins de la dérogation à certaines conditions applicables aux mouvements non commerciaux, le modèle des documents d’identification destinés à accompagner les animaux de compagnie des espèces répertoriées à l’annexe I, partie A, lors de mouvements non commerciaux à destination d’un État membre depuis un autre État membre ou depuis un territoire ou un pays tiers, et les règles sur la forme et la présentation des déclarations à signer, ainsi que les langues utilisées dans ces déclarations, le présent règlement devrait entrer en vigueur le jour de sa publication dans le Journal officiel de l’Union européenne
In order to ensure the simultaneous publication of this Regulation and of the implementing acts regarding the lists of territories and third countries established for the purpose of derogating from certain conditions applicable to non-commercial movement, regarding the model for the identification documents that are to accompany pet animals of the species listed in Part A of Annex I during non-commercial movement into a Member State from another Member State or from a territory or a third country, and regarding the rules on the format, layout and languages of the declarations to be signed, this Regulation should enter into force on the day of its publication in the Official Journal of the European Union

(8)Afin d'assurer sa cohérence avec la législation actuelle de l'Union européenne dans le domaine des services financiers et de garantir un maximum de stabilité financière dans tous les types d'établissements, cette procédure de résolution devrait non seulement s'appliquer aux établissements de crédit, mais aussi aux entreprises d'investissement soumises aux exigences prudentielles fixées par la directive 2006/49/CE du Parlement européen et du Conseil du 14 juin 2006 sur l'adéquation des fonds propres des entreprises d'investissement et des établissements de crédit. (8)In order to ensure consistency with existing Union legislation in the area of financial services as well as the greatest possible level of financial stability across the spectrum of institutions, the resolution regime should not only apply to credit institutions but also to investment firms subject to the prudential requirements laid down by Directive 2006/49/EC of the European Parliament and of the Council of 14 June 2006 on the capital adequacy of investment firms and credit institutions The regime should also apply to financial holding companies, mixed financial holding companies provided for inDirective 2002/87/EC of the European Parliament and of the Council of 16 December 2002 on the supplementary supervision of credit institutions, insurance undertakings and investment firms in a financial conglomerateand amending Council Directives 73/239/EEC, 79/267/EEC, 92/49/EEC, 92/96/EEC, 93/6/EEC and 93/22/EEC, and Directives 98/78/EC and 2000/12/EC of the European Parliament and of the Councilmixed-activity holding companies and financial institutions, when the latter are subsidiaries of a credit institution or an investment firm.The crisis has demonstrated that the insolvency of an entity affiliated to a group can rapidly impact the solvency of the whole group and, thus, even have its own systemic implications.

The rights under this Regulation cover all types of flight by European airlines, charter or regular, even if the flight departs from an airport located abroad when this flight is to the EU and the flight is operated by an airline licensed in the EU, provided the passengers have not benefited from services or received compensation or assistance in the third country (as for example in the case of the United States).

European airlines were faced with a dreadful dilemma: either to comply with the PNR requirement and risk being taken to court by their national data protection authorities, or not to comply, which would have triggered intrusive extra searches of their passengers. This would have resulted in enormous delays and a potentially serious loss of business for EU airlines to US airlines, which were supplying the required data.
